I submitted two new loans to this company by the name Athas Capital Group because I heard they had a stated income product. When I submitted the loans to them I was told I had to use their AMC Company (Appraisal Management Company) to order the appraisals, so I did. The AMC company requires the client to pay for the appraisal and the clients credit card is taken down , but no charged until the appraisals are ready to be completed.
The client decided not to proceed with the refinance and wanted me to stop everything, I said no problem and turned down the file. A day later I get a call from an angry client saying why did Athas charge $900.00 on his card. I said I have NO idea, but I'll find out. I contacted my Rep with Athas Brandon Rodriguez and asked him why they charged the client's credit card when the cleint cancelled the loan and the appraisals were never done, his response was that's our policy.
I said you guys can't charge a client for something that was never completed, he said he would look into it and conatct me back. A short while later I get an email from a Todd Kaplan the National Sales Manager with Athas saying he isn't refunding the client back the appraisal money because the client signed a paper saying NO REFUNDS. I replyed back that the appraisals were never done, the loan was cancelled before the appraisals were scheduled. He didn't respond after that.
Lets take a long look at this. You have a Rep.(Brandon Rodriguez) who charged a clients credit card AFTER the client cancelled the loan. You have a National Sales Manager (Todd Kaplan) who flat out states he's not refunding the client back the appraisal money that Athas Capital Group charged the client for appraisals their company never did.
The loan was cancelled by the client before the appraisals were even scheduled to be completed, how can you jusify STEALING this clients money?
