This complaint and warning is for everyone looking at home loans.

Please heed this warning and steer clear of Caliber Home Loans AND Elva Bower at ERA in Colorado Springs.

These people have absolutely no business or clue of how to serve the customer with integrity and the knowledge required for real estate and lending.

The incident I wish to inform you of will be summarized of course, however be aware that this forum of complaint will not cease.

This is my 6th home purchase and I have family and friends in Real Estate, escrow and lending.

The home we located with Elva at ERA was in the Briargate subdivision of Colorado Springs. Our prequal was completed by Paul Abair at Caliber Home Loans in Colorado Springs. Being recommended by Elva early on, we were led to believe Paul could be a safe extension to proceed with our home purchase.

Offer was submitted with hesitation as we began to see signs of the lack of knowledge from Elva Bower for this process. She had to make 2 calls to a colleague for questions. Offer finally submitted after 3 attempts.

First f2f meeting with Paul for lending paperwork one week later. Credit scores, w2's, etc. Two meetings later, Paul still did not know everything we needed to proceed. My suggestions and knowledge were not taken seriously as to what would be needed to continue. He was completely dumbfounded when my knowledge was shown to be correct. Excuses followed daily from Paul.

Emails and faxes continued up to RIGHT OF REFUSAL. However many times I explained incomes to Paul, he was ignorant to the clear facts of not including my mother-in-law to continue. His lack of communication for 10 days prior to ROR, was stressful enough. HERE IS WHERE THIS GETS TROUBLESOME.

I received a call from Paul 12 hours after our ROR DEADLINE HAD PASSED. He tried to explain that the underwriter had not heard back from us and refused to qualify us unless my mother-in-law was able to be on the paper with us. Paul also explained that he did not call me the day before due to underwriters and himself wanting to go home. Income levels were met from the beginning and no mention or requirements were drawn to conclude that she would need to be included until after this deadline.

Long story short: Since the phone call was made 12 hours past the ROR DEADLINE, we were not eligible to receive our earnest money of $2,000.00.

Paul was very lacking of keeping his client informed of the process.

Elva was completely ignorant of the requirements needed in offers, inspections, counter-offers.

MY WARNING FOR EVERYONE - STAY CLEAR OF ERA AND CALIBER HOME LOANS.

My home loan was with Bank of America. It was transfered to Caliber Home Loans in Seprtmber of 2014. I tried to do a Home Modification Loan with Bank of Americe for over 3 years. Bank of America just kept giving me the run around. When I called them they would listen to all the cirmstances and transfer me around from one dept. to another, each time having to elplain the whole sistuation every time. I had a loss of about $4000.00 in income for the year. in 2011 my hours were cut at work, and shortly after that my wife's income was cut also which was about $3600.00 a year. So we had a total loss of income about $8000.00 a year. I explain all this and send in proof to Bank of America, They act like they are concerned and want to help you. But really they are just dragging it out to get you futher behind on your payments. I wouild call them all the time, and it was always the same putting me on hold and transfering me around, never getting any answers. And explaining the whole thing over and over again. They never gave me a modification loan. They caused me to get futher behind on payments. Then all of a sudden my loan is sold to another Company. Caliber Home Loans.

I explained all this to Caliber Home Loans. They acted so concerner and like they were going to help my family. But it was not long before i was seeing Caliber doing the same thing. Caliber employees had told me not to make any payments during the home modification process. Then I kept sending the information they requested. I started just calling them all the time.

They kept requesting me to send the same information over and over. They told me what to send over the pone at first. I was never recieving any information by mail. This went on for about 3 months. I was on the phone in December and i kept asking why are they not sending me anything in the mail. I believe it was so they could say you did not send someting we requested, and there would be no mail showing what they wanted sent. So they could play this game over and over. To keep dragging it out more and more. They said they were sending me information in the mail, but i did not ever recieve it. So they were making it look like i was not responding to them like i did not care or try to do anything to follow through. Then they start saying they were sending it to my Lawyer. Then this started going on for a while. I would call and they said i never responded to the information they sent out to me. That it was sent to my Lawyer. Just another way to continue dragging it out. When i contacted my Lawyer he would always say he had not recieved anything from Caliber. So called and the lady i was talking with said we have sent everything to Mr. Hawkins your Lawyer. I responded who is that. That is not my Lawyer. So now it looked like they were sending the paperwork to the wrong place all this time. So i believe that was just a lie to cover up for the missing paper work, and to drag it out longer and putting me father behind on the payments. They are horrible people and a horrible company. Now they are seeking to foreclosure on my home. I am in a Chapter 13 Bankruptcy,So they have to file a petition to the court to proceed to foreclose on our home. We have lived here for over 20 years. The other companies involved in this also are U.S.Bank trustee for LSF9 Master Participation Trust. They would rather go through all this scam with the loan modification program so they can foreclose and take your home, instead of helping you to keep your home. If they were a good company they could use one of the many programs to help you keep your home. As a Christian I know The LORD is going to deal with them. February 20, 2015.

As I stated above we had our home loan through HSBC/HFC and/or Household Financial. Back in May 2012, we contacted HSBC/HFC and requested a payoff amount for our home which they provided and we then paid off our home. We later received from them a letter dated May 21, 2012, thanking us for choosing their company for our financial needs and that they are "pleased to inform you that the above-referenced account is now paid in full." We also received from HSBC by mail (postage date: May 22, 2012) the DEED OF TRUST with the LOAN AGREEMENT attached and stamped PAID. Additionally we have the SUBSTITUTION OF TRUSTEE showing the recording was requested by: HSBC Consumer Lending, and when recorded return to Current Trustor (my husband) Gunter ________ and dated May 25, 2012; as well as the FULL RECONVEYANCE with that same information and date.

About a year after we paid off our home HSBC/HFC begins billing us for mortgage payments once again. We began numerous correspondence back and forth with HSBC/HFC as to why they are billing us mortgage payments when we have paid off our home. We have never gotten anywhere and then they began stating we are in default of our mortgage. In January of this year 2014 we received notice that our SO-CALLED Loan with HSBC/HFC has been transferred through a trust to Caliber Home Loans and HSBC/HFC after the transfer in February 2013 (I believe) filed with the San Bernardino County Recorders office paperword attempting to reverse the Full Reconveyance. We have in turn filed our own paperwork with the County of Non-Acceptance of their filings, etc. Now Caliber Home Loans has been coming after us for mortgage payments and we have responded with numerous certifed letters and demands of proof from them that they have the rights to be pursuing us for payments only to receive copies of our original loan documents from HSBC/HFC back in 2006 in response to some of our correspondence and no response at all to some of our other correspondence. They have not provided us with one thing justifying their pursuits against us.

In the meantime, as of a week ago on Monday, August 11, 2014, Caliber Home Loans has filed with the County of San Bernardino a NOTICE OF DEFAULT where they also state on the last page a complete lie stating "2. The mortgage servicer has tried with due diligence to contact the borrower as reqired by California Civil Code section 2923.55(f) but has not made contact despite such due diligence. The due diligence efforts were satified on March 26, 2014", when in fact we have had numerous contact with them via correspondence over the entire time since they purchased this wrongful loan from HSBC/HFC. We worked very hard to pay this home off in full and it boggles my mind that a mortgage company can later decide that they can start coming after us for new loan payment then to sell this illegal loan to Caliber Home Loans and now Caliber is going to try and forclose on a home that has been paid off. How is this legal.

It is time for us to begin legal action immediately. I really did not want to declare bankruptcy and hope that there is another way. Since paying off our home I have lost my job and we now are struggling financially but need help in saving our home -- is there anyone that can help us on some kind of contingency basis?

When I received my July mortgagte statement, it showed an additional charge of $42.35 with no explanation that had been added to my regular monthly payment. I went to Caliber Home Loans website to their Contact Us page and filled out the form asking them what the additional charge was for.

The next day I received an email telling me they would send me a letter explaining the additional charge.

I waited a week but did not receive any letter. Not wanting to be late on my payment, I went ahead and paid the added charge of $42.35 and sent them my mortgage payment. A few days later the letter came.

The letter said the this additional charge of $42.35 was a late tax payment penalty charged by my county property tax office. But wait, I don't get the tax bills on my house. Those bills go to Caliber Home Loans. Caliber Home Loans escrows my property taxes in my monthly payment. They are responsible for paying my taxes on time. So why am I having to pay a penalty for late payment when it is their fault the payment was late, not mine.

I wrote them a letter demanding an immediate refund or I would file a complaint with this website as well as the Federal Trade Commission. No response, so I am filing this RIPOFF REPORT against Caliber Home Loans for making me pay for their mistaakes.

My loan was not with this mortgage company originally. It was sold to them a year after I bought my house. I had no say so in the matter. I think this company is probably ripping of thousands of people for their incompetence in paying taxes on time. Who knows how much money they are raking in for this sort of thing. I really don't even know if they were actually late on my payment nor do I know how much the penalty might be if they were. For all I know this company has just totally ripped me off for $42.35 and that really bothers me that a big mortgage company can get away with this. I'd love to know how many other customers of theirs have been charged these bogus charges.
