I starting working for Environmental Testing Group, d/b/a MIT (Mold Inspection & Testing) in approximately February 2013 out of my home office. I was hired as there Mold Assessor or Mold Inspector for the Daytona Beach, Orlando, Titusville, Jacksonville area. I had a verbal agreement to provide mold testing services for 25% plus a fuel surcharge. So they would pay me of $85.00 (and I did all the work). The agreement was for them to text me with the job information and I would let them know if I was available for the job and when. I was to contact the customer and schedule them for the appointment. Once I was on the job, I would have the customer sign there contract, collect the money for the inspection and deposit the money into their bank account at Chase. I was to give the customer a business card with the name MIT on it. I was also required to generate there reports and continue contact with the customer, again with MIT name on it.
They used my physical home address on there website stating they would compensate me later, as business picked up. Then later refused to give me anymore work.
The owner Adam Pacha has refused to pay me for the work I completed for them, he wants me to provide the records to him. His employees or him has always made errors in my pay and refused to pay unless they got paid and then stated they never got paid. It was always an excuse.
I believe they misclassify us as an Independent Contractors, they treated us like employees for the following reasons:
We were given a manual and instructions how to complete a report.
They established a schedule and working hours. They required specific days they wanted us to work, including after hours and weekends.
They gave us deadlines as to when reports needed to be generated.
They provided us with supplies to do the job: business cards, contracts, stationary and mold testing supplies.
They paid for travel – fuel .
They never allowed us to submit an Invoice to them for work performed. They paid us biweekly – through direct deposit into personal bank account. They didn’t always pay for everything completed, stating they hadn’t got paid yet.
NO signed agreements or contract stating we are independent contractors, they treated us like employees.
It is unclear where they are located, the address on the contracts I believe is 63 Portwine Street, Roselle, Illinois 60172 . The owner stated they are working from a home in a city somewhere, but Its unknown where they are actually located. Telephone numbers that I have for them are as follows:
