Fred Loya Insurance Reviews

  • Apr 24, 2015

I have been a custumer of Fred Loya Insurance for over 11 years, They have never paid me a claim, they renew policies automatically and take bank draft payments from my bank.

I had insured several vehicles with them, and they never paid none of my claims when my vehicle has been involved in an accident, which I had two accidents only and they declined my claims for bogus reasons.

On June 2010, my jeep was involved in a rear end accident hit by someone else but it was being drive by my son in law, which by the way has a texas driver license.

I went to Fred Loya office and explained what happen, they told me that my son in law was "excluded from my policy" so they will not cover any damages, fortunatelly I had to the money to fix my car.

But the same day I requested Fred Loya employee a lady named Adriana, to remove all the exclusions in my policy, they had in their exclusions several people including my minor children that were 15, 11, 6 years old, they had excluded my oldest daughter and my oldest boy whom are licensed to drive in Texas, but also they had other people that does not live in my property and a guy that has been dead since 2006.

I requested that lady Adriana to remove all those exclusions from my policy, as it is against the law to have kids under the age of 15 excluded from an Insurance Policy.

She told me she did it and made me sign in a machine they used to have connected to the computer, but at the time that I requested copies of what I had signed she told me her printer wasn't working that she will mail the changes just made on the policy and she was sorry for her printer not working,

I have a witness on this transaction that will come to court to testify about this specific issue with they way this company operate their business, as this employee maliciously performed an action against my insurance needs and favorite her employer Fred Loya Insurance.

The only times that I have been forced to go to their offices in person its when I had the need to make changes, as they do not do anything on the phone, and I believe that is the trick they use to harm people, they make you sign documents without explaining customers of they are signing,

they do not disclose to customers coverages as PIP and IUM, as they do not want to be responsible in case of an accident to pay for what customers are paying for,

they do not explain customers about their way of applying exclusions to your policy and how that may affect you directly in case of an accident.

They act maliciously and knowing and willfully aware of what they are doing to denied claims in case of incidents. This past June 2013 I did some changes of my policy, as I removed a vehicle that I was only paying for Liability,

and add a vehicle that needed full coverage, collision and comprenhension and liability, I made sure I told the lady that helped me that everything else will stay the same in my policy including the "no exclusions" have to be in effect.

She said yes, everything is in place, gave me only the new insurance ID card, it was about the time they close, on a Saturday, I needed the vehicle to be insured and did not have time to shop somewhere else,

unfortunately my car was involved in a car accident on November 30, 2013, it was being driven by my son who has a driver license and not supposed to be excluded from my policy, as since day one when I became their customer I made emphasis that I needed and was shopping for a policy with "No exclusions",,

I am the customer, my car is insured, and now after being paying Fred Loya more than $20,000.00 in insurance since 2002, they are telling me that they are simply not going to pay my claim, neither for rental towing or storage, because my son is excluded from my policy.

They denied claims cold turkey, without even doing an investigation, and now here I am ready to file a law suit against these thieves. Fred Loya train their employees this way, and their employees know what they are doing in order not to have valid claims paid by this company.

They have been sanctioned already here in Texas for practicing Bad faith insurance actions against, consumers, and the sad thing is that they defend their self telling you well that employee its not longer working for Fred Loya,

and its nothing I can do for you now, we have your signature accepting our policies and that its our defense, but they don't admit how they engaged in bad insurance practices, and how they are harming customers all over the nation.

I am ready to file a lawsuit against them, that its going to cost me money as those cases are not handled by lawyers on contingency basis, and I am filing against them with the BBB, Texas attorney General, and TDI,(Texas Department of Insurance)..

If you are a victim of Fred Loya bad faith insurance practices, please contact me, so we can file a new class lawsuit against this company as all they do is ripp off people, and they have to stop.

My complaint is against Loya Home Insurance AKA(Fred Loya), on 03/18/2014, I receive a letter from the insurance stating that I have pre-exisiting damages to my home. I was hereby given notice that repairs to the damages must be complete within 30 days of this notice. Failure to do so will result in non-renewal of my policy.

I called Loya Insurance company and I told employee that I didn't understand the letter that was mailed to me. I told the employee that I had been a customer since 2007 and I had only made one claim and that was in 2008 due to Hurricane Ike. I stated to her that I had all the damages repaired in 2008, and any damages that has occurred is due to all the bad weather we have been received 2013 and this year.

The employee told me that I had 30 days to repairs all damages to my home and take photos and bring them to one of their locate offices. I stated to her, if y'all are telling me that I have damages to my home, y'all should have the photos. I stated to the employee, why would y'all send me a letter stating that I have pre-existing damages, if y'all haven't been to my home.

I stated to the employee, I cannot afford to do any repairs to my home in 30 days. I also stated to her if they wanted me to do any repairs to my home, I would need to file a claim. Because I have shingles from my roof missing due to the high winds that occurred in April of this year. I also stated that the front of my home has water damages due to all the rain that we had this year.

I also told the employee that I did not have a camera, but I have my cell phone and I could email or message them the photos of my home. The employee stated that I could not email or fax or mail any photos to any Loya Insurance company. She stated that I would have to come into one of their locate office, I stated to the employee that I did not have time to come into one of their offices. I asked the employee, if someone from their office could come to my home and take the photos. The employee said ""NO"", I would have to take the photos.

I asked her to mail me a letter stating what photos they needed of my home. The employee stated, she could not mail me a letter of any repairs/damages because it was pretaining to 2008. I stated to the employee that none of this make sense, if y'all need photos of my home, I need to know what was needed. The employee told me to take photos of my entire house inside and out. I told her this was the insurance company job, not mine. My mortgage company pays my home Insurance on time every year. I'm sure part of taking photos is the Insurance company job.

However, I tried to comply with them, I mailed them a certified letter/regular letter requestingt that they mail me a letter of the photos that they needed me to take. I also mailed them a photo of the entire outside of my home.

To make a long story short on 04/21/2014, I received a letter from Loya Insurance Comapny canceling my policy. Which none of this sounds legal to me. I need to know what I can do legally to this company.
