My adopted son who is Vietnamese was employed at Southern California Auto Club as the top smog technician in the smog service department for almost eight years. He was an excellent worker and was chosen employee of the month in the Westways magazine.

His co-workers were Hispanic, and one of them kept trying to get him to cheat on the smog tests so they could get more jobs done. My son refused to do that, so this man began taunting him in various ways. He used racial slurs against him; (f...ing geek, f...ing gxxx, f...ing nxx). He only did it when no one was close enough to hear what he said.

He also harassed my son in various ways, like cutting off his smog machine when he was into a smog check, causing my son to have to start over. At least once, he did something that caused my son to almost drive over the rollers, which was dangerous.

He got in my son's face and told him he would have someone "work him over". He would come over to where my son was working on a customer's car and make rude remarks about my son's work in front of the customers. He would make up falsehoods about my son to some customers and tell them to report him to his supervisor.

He was so jealous of my son getting so many customer complimentary cards that he made up false ones complimenting himself.

These things took place on almost a daily basis, and it was affecting my son emotionally and caused him to have GI problems.

My son reported these things to his supervisor, but to no avail. He reported it to Human Resources, but very little or almost nothing changed. Their solution was to send my son to the Los Angeles shop, which my son did not want to do. After all, he was the victim, so why should he have to go somewhere else?

My son had a serious work injury in June, 2008 and was put on Worker's Compensation.

We later filed a lawsuit against the Auto Club for the mistreatment and other reasons, but unfortunately we chose a bad attorney who kept postponing the case in favor of bigger cases until over four years had passed.

The case went to JAMS in August 2014. The judge seemed very close with the Auto Club attorney and pretty much let him run things in the arbitration. My son and I gave the judge all the evidence he needed, including evidence that proved some of the Auto Club witnesses lied under oath.

In January 2015, my son received a so-called "Award Letter" basically saying he will receive nothing, and that a second letter would be sent in February.

The judge may as well have stuck a knife in my son's heart, and mine also for that matter. We worked so very, very hard to try to win this case but it was all in vain because he had a totally unfair judge.

We don't know if this was binding arbitration, but assume that it is. Can you please offer advice as to anything we might be able to do about this? We are both low income and don't have money to do anything
