To whom it may concern; I live in Shelby, NC where I have been a Cleveland County resident since 1998. In Jacksonville, MS a little girl was thrown out of a KFC because of her appearance due to being attacked by her grandfather's dogs. Later it was stated by KFC after the "investigation" they have no "proof" of the allegation. It was stated later, "HOAX" just to get "money". Which I find it so hard to believe this was made up because of what I want to share publically. September 10, 2014, I was assaulted by a KFC employee here in Shelby, NC on high 74. I am a 46 year old disabled adult. Pastors wife/preacher, mother of three, 30, 28, 27 and grandmother to 4. I did not get justices threw our court system. My rights where violated by the system here in Shelby NC, and the Shelby Police Dept. I was not given the right to be present or informed summons; therefore assault chargers where dismissed by the DA because I wasn't present for a trial I had no knowledge of. Our Cleveland County Sheriff Office normally serves summons for the county, but this particular summons was "supposedly" handled by the City of Shelby Police Department and was returned as non-deliverable address. I know in a witness case, the witness can be contacted by phone which never happened. We gave a (home/cell) phone number and the name of the place where my husband is employed. And they know us, and how to contact us, but we were told they "couldn't or wouldn't" make calls! No certified letter or nothing. So I feel the system let me down by not using proper measures to contact me and the welfare of the person who assaulted me was protected, where as the victim myself, was of none importance along with the mental suffering and pain I went threw for about three months. I had hospital reports, pictures. etc. I am (mixed) a black women, and the person who assaulted me, a white 19 year old female. This is not the first time of experiencing problems with the Shelby Police Department. A close friend in our church, a Shelby Police Officer was running around with the spouses, spouse. The spouse in our church went to the Captain of the Shelby Police Department with evidence to prove what was happening. "Supposedly" the "investigation" showed no truth in it! But after our close friend and spouse divorced, the officer was soon after married to the person he was accused of running around with. So, we all new the officer and stood with the close friend and they knew who we were and that I stance was against this as well as our advice to go to the Shelby Police Department on this officer was very much encouraged. A little bite after this, my husband, the "Pastor" was given a ticket by this same "officer". So I can see why the summons was never served. And if I wasn't home, my daughter and two grand children are always there. So frankly, I feel there was no attempt or maybe not enough effort to reach me with all I had suffered threw. The DA did not even try to continue the case seeing I wasn't present or they couldn't reach me as they so say. But now, this month, a week before I was told by KFC insurance adjuster on February 23, 2015, the case was dismissed, the Cleveland County Sheriff's Office was blowing up my phone looking for a person of interest to arrest. Sounds kind a funny! Now, I received a letter from KFC's insurance company dated, January 20, 2015, which states, "Our investigation has revealed that you sustained injuries as a result of the above captioned accident. The date they have is, September 09, 2014. The incident date was, September 10, 2014. They where told and I guess like with the little girl that was bitten by her grandfather's dogs, the date was incorrect concerning the grand daughter being "thrown" out by a KFC employee in Jacksonville, MS. They later indicated it was a "HOAX" to get "MONEY". No, KFC covers for the wrong of their employees as well as not taking responsibility for the people they "HIRE" and put in these food chains. It's, "NO FAULT, NOT LIABLE FOR THE EMPLOYEES!" They are not being accountable and it is just not fair to customers who come into "THEIR" establishments to be assaulted, put out/disrespected. The call from the insurance company's adjuster on February 23, 2015 indicated they was "NOT LIABLE" because charges had been dismissed on the employee because I did not show up for court.......I was kin a stunned......Then I said, "what?" I was never notified to come to court! And the insurance adjuster goes on to say, very jolly sounding, I have statements that it didn't happen that way from witnesses in the store....I said, "that's a lie". If a customers saw what happen, they should of tried to help me up off the cement where I landed! The adjuster then states, your injuries happen somewhere else........?????? I said, ok, God will have to have the last word in this! Conversation was then over. Sadly to say, half of The Shelby Police Department appear to have a prejudice streak. Having needed some of their services in the past, "TO SERVE AND PROTECT," I wondered how some had actual became officers. The day I was assaulted by the KFC employee, a officer with the prejudice streak came out......I was setting on the curb of the KFC property side walk, and after talking with the officer about what had happen and the officer speaking with the accursed, he (the officer) states, "she said she didn't do it!" But here is her name and address, you can talk to the magistrate. Where I landed in the scurbs, then back on the cement/side walk of the KFC property on my back, scrubs where all over cement/side walk and I'm setting here holding my right hand and arm that was in pain from the assault by the KFC employee. Common sense should of at least kicked in for him to realize something went on here and this black lady is setting here with scrubs all in her hair, hair matted, I had got it done about two days before the incident, scrubs everywhere and she's holding her hand and arm? "The prejudice streak officer". If the shoe would of been on the other foot, would I have went to jail?" Incident here in Shelby happen where the shoe was on the other foot. A black pregnant women was accursed of assaulting people, property damages, and "supposedly" hitting a person with her vehicle. She was being attacked by certain employees, but; the whole story switch a rue by the Shelby Police Department. One officer went as far as "you people!" The officer was reported to the captain where nothing was ever done. The pregnant woman was taken to the hospital and upon discharge, there where five Shelby Police Cars that came to the hospital and pushed her out in a wheel chair with hand cuffs on at seven months pregnant and making jokes and laughing about the incident as they put her in the police vehicle. The pregnant black woman gave birth a month early due to all the stress and none-sense allegations she had to endure. The Shelby Police Captain was told what happen, nothing came out of it, (when officers arrested her at the hospital) she was railed road in the Shelby Court System as The "OFFICERS" who arrested her set in the court room laughing. To be honest, would I have had a chance to even get justice in this city? I was never given a fair chance to present my side in the court of law. And KFC holding up clean hands only not to know they are dirty. Almost like, dirt covering up dirt, only to become dirty. Sadly to say, when this happens, it only opens up doors around the world for other employees to do the same. They, KFC will lose in the long run. These things can't keep happening and they, KFC think that their employees behavior is alright. Eventually sales will decline and chains could even start to close due to their irresponsibility for the people they hire. The only thing KFC was responsible for was their scrubs that where damaged by the employee shoving me over in them. They where liable for the scrubs, not the customer. Scrubs where replaced with tale pine trees that reach almost to the top of the building from the point where I was shoved on the side, to the front of the store. (have before and after pictures) So, even the bushes was badly damaged as well, the replacement from scrubs to pine trees looks as if nothing was ever damaged on the property. There are other cases where, hot oil was poured on a customer, customer had teeth knocked out by KFC employee who was a felon. Customer could not decide what fixings they wanted so the KFC employee pulls a gun from under the counter and beats the customer knocking teeth out and other injuries. KFC, "NO FAUT, NOT LIABLE" for the employees "WE HIRE." And the stories go on and on. Just be mindful, every time a KFC door is opened, will you be assaulted, killed, or disrespected at the hands of one of the KFC employees? It could of happen anywhere at any eating establishment; but the fact is, it didn't. It happen at a KFC establishment. Seeing all the things that go on with these incompetent KFC employees on top of management not being liable for the things their employees do, I will not step foot back on the property not even for free chicken and biscuits!
