On Dec. 4,2014 I took my car to this dealership. I had never been here before. It was on a Thursday. In the early moring hours. I was greeted by a male Hispanic adult. The name is possibly: Jaime Avila. His supposed job title is :Service Advisor. According to the invoice going of Face Book. The reason for my visit was : My winshield wippers stopped working . They stopped on : Dec.3,2014. The other reason for this visit was to inquire the slight squelling sound of a unknown perhaps belt. Note: While waiting in the lobby. I was just talking to the phone operator. Then suddenly and very aggressively this male Hispanic adult walked and stood directly in my face.The impression was similar to as perhaps some one chalenging and dueling .To perhaps instigate a fight. Or California Penal Code:415.1.2.and subdivision:3. No fist fight occured: The action it self; Appeared to be : ( Attempt ): California Penal Code:664 . The act against public policy would be: ( Assualt ) :California Penal Code:240. This was the first act against public policy. The next act against public policy: This individual standing approximately four inches from my face : Demanded me to tell him my name .The manner was : Aggressive and very athoritarian. He demaded my name three times. Then the subject : Demanded to know what was my favorite coffee. The subject prior to walking away assulted me .When he used his right hand to slap my left arm .Just bellow the rotator cup. This took place: Dec.4,2014. The female Hispanic adult using the phone perhaps the phone service for this dealership ,indicated his name was : Tito. The spelling may not be exact.Yet she not only stated that his name was : Tito, but that his actions were the norm. Meaning his actions against public policy are acceptable at this dealership. So this individual's first act against public policy was violating: Calif. Gov.Code: 12900. Under : Hazing,harassment ,which coincides with badering ,brow beating. Next : Assualt .A preventable touch to a customer. A unwelcomed touch. He then gave the impression he was into sales. By offering to sell me a car for only :$50.00 a month. I indicated : " I was not there to buy a car". " Just to fix the one I have". As we are aware employees do occassionaly stick together and by now perhaps the dealership lobby camera has been taped over.To waive any liability.The excuse the dealership will perhaps make or use is: Their at will employee was just being friendly. Or the other excuse for these two acts against public policy would perhaps be: They did'nt see it .Or they did'nt see any thing wrong in their at will employees actions. Next: I attempted to speak with another at will employee pertaing to the two acts against public policy. The male Hispanic adult claimed he was the sales manager. The name I can't recall. The desk he chose was next to the back glass ,just north of the female Hispanic adult's desk. To the right of where this male Hispanic adult that claimed to be a sales manager sat: Tito. He was observed laughing and giggling. As though he knew this dealership would support and back him up no matter what he does. Its unknown if the subject that I spoke with was a sales manager.He displayed no supporting evidence. The next incident that occured at this dealership. Service Advisor: Jaime Avila ,possibly the name of ,what appears a very over weight ,male Hispanic adult from perhaps parts or service,stated the following: " You were right the windshield wipper motor is defective." He continued: " The pully and water pump need replacing ,and we will give you a 12 month warranty for all parts. I stated and asked exactly when can you have all these parts"? He stated: "Tommorow at:10:30 a.m." This would be : Friday ,Dec.5,2014. Continuing: I asked ;"How much would it be just for the parts"? The at will employee stated the following: " It will be three hundred and ninety dollars and thirteen cents". He continued: " This is just for the parts and they all will be in tommorow at ,ten thirty ". Then I asked," How much will it be for the labor just to install two parts"? He then stated," That will be : " Six hundred and seventy two dollars." Continuing: I then paid the at will employee ,with expectations to obtain all my parts on,Friday Dec.5,2014. I obtained all the paper work. Then I read the disclaimer of the paper work and was very shocked. I reads with a fine tooth brush as follows and broken down in layman's terms: ( Disclaimer of warranties ) Any warranties on the products sold hereby are those made by the manufacturer the seller hereby . Note: The seller could equal the dealership? Continuing: Verbally or expressly or in other words: Verbally or in writing. This is what is meant by: Expressly or implied. Disclaimer: This could equal will not be : Respomsible,held accountable or be liable ? Disclaims: all warranties either : ( express or implied ). Or in layman's terms: ( Verbally and in writing). This could in reality with out all the big words and mumbo jumbo mean: This dealership does not warranty its parts. ( Now please pay and sign on the dotted line and give me you're money). This athorizes us to take you're money and rip you off with you're permission.Plus: If the part is defective you are on you're own. Thank you for being a very stupid and compliant ignorant customer thank you for making me rich and you poor? Continuing: Of merchantability ,big words for dealership. Of fitness ,for a particular purpose . In small words ,it sounds like: If the part is dfective or out of shape ,the dealership is : Not responsible. This means not liable. Also could care less. Idiot you are on you're own. You should have read the small fine print before signing the paper work,idiot . Continuing: Not liable You bought it ,tuff luck you are on you're own. Continuing: And the seller or dealership : Neither assumes nor authorizes any other person to assume for it any liability in connection with the sale of said products. Or in other words this dealership wants the complete credit for selling you a defective product that you are stuck with,they will not warranty .They refuse to allow any one else to give any one else the credit. They want the bragging rights of selling you a defective product and treating you like an idiot. You signed for it and paid them. You signed and agreed to pay for the part working or not working. With ot a warranty ? They want the bragging rights? They refuse for any one else to get the credit for taking advantage of you as a customer. Continuing: For it any liability in connection with the sale of said products.In other words they will take responsibility of selling a defective product.But if it is defective they want all the credit for selling a defective product. With out a warranty . Contining : Any limitation: : Contained : Herin: does not apply where prohibited by law. So what ever they the dealership is saying is: Forget what we are saying if its against the law. Example: Perhaps: Fraud and Deciet. California Penal Codes: 484-502.9 ,Chapter:32 ,California Penal Code:528-589 and Business and Professions Code:17500-17509 ???? This is what it might mean in regards to against the law. Also if it applies: Misrepresentation: California Labor Codes:1050-1053 ? In conclusion: Dec.5,2014 ,the Friday that followed . I called this in opinion very : Corrupt ,disgusting ,piss poor Kia Dealership. Here is the response received: " All the parts are in ,except the , windshield wipper motor? I stated ," I will be in to obtain the $390.00 dollars I paid, keep you're parts". I obtained my money back.Service Advisor: Jaime Avila ,could be the at will employee that lead me on and lied to me. It cant be a : Honest Mistake of Fact. He may not qualify: (1) Medically diagnosed imbacile from birth .(2) ( Unconcious) (3)( Ignorant ). California Penal Code: ( 26) He is required to work with best efforts.Calif.Labor Code:2924. The managers are required to show:( Due Care, or reasonable care to not just the employees that work for them but all customers at all times ). Note: Follow up: I had a much more repitable and experinced mechanic inspect the car. Approved by : Tripple AAA. The windshield wipper motor is not ,broken or defective.The connecting arms are dislocated and need two or three small parts. Mechanic Cha : Lied. To prove that some mechanics enjoy lying to customers on their own or get told to by managers at the dealership. Not even one of these corrupt Kia expert mechanics will vollunteer for the following test of truth. I call it the :( Trinity Of Truth Test ) Step # 1. All these corrupt mechanics will volunteer for: http://www.no.lie.m.r.i.com . Next: ( 2)California Evidence Code:801.70 . This is : Sodium Pentethel or the lie truth serum. If its induced in the subject. Whats very significant is the dosage coincides with the body weight of the subject. Next: (3) California Evidence Code: Section:795. This is hypnosis. These two California Evidence Codes: Past The Kelly Frye Rule of scentific evidence and are admissable in a court of law. With these prerequsites: (A) No shoes so subject can't put thumb tacks. (B) Blood and urine test, (C) A current toxicology report,by a current and licensed medical doctor expert in this field. ( D) The subject will volunteer to be filmed on : You Tube for the entire and complet and in detail : ( Trinity Of Truth Test ). If and they will refuse. This will show mass millions of people all over the world : ( Reasonable Doubt ) .This equals guilt. If they volunteer : (1) Question one. Were you ever told by any manager at any time to lie to any customer? Question :(2) Did you at any time ,ever lie to any customer? (3) Question (3) Were you ever told by any supervisor to lie,cheat or do or say anything that was a lie ? ( 4) Question : Did you see any other mechanic lie or fix one thing and damage anything of any customer's car at any time? ( 5) Question : Would you rather have lots of over time or lots of money as compared to being : Honest and completly truthful to all customers ?? ? (6) Question: Do you mind being filmed for mass millions of people to judge you on :( You Tube ) ?????? For The complete and entire detailed : ( Trinity Of Truth Test ). (7) Question : Will you , the managers,the mechanics,the sales and parts department refuse??? Why? The answer is obvious brother and sister consumers: ( Reasonable Doubt ). This as we knows : Equals only one thing,brother and sister consumers: ( Guilt ,Guilt,Guilt ).Look at all the negative reviews on :( Yelp and those this dealership wants perhaps in the deleted or filtered area . Why? Why ?Why ? The answer is: ( Guilt ), ( Guilt), ( Guilt).
