SCAM - Thieves

In 2016 I paid $975.00 to publish my book on my genealogy. They looked through the book and emailed me that I would have to remove one of the family photographs, which has my grandfather and his 10 siblings and parents. The photograph was taken in 1930. However half was taken in San Jose, CA and the other half in Portugal. There is NO Identification who the photographers were, neither on the front nor back. Lulu.com refused to publish my book until I remove this photo. I demanded a refund and was told I have to do it in writing. I sent two emails and they refuse to give me answers and money back. Lulu.com, Lulu Press, Inc are subsidiaries of Lulu Enterprises, Inc. This company is a complete fraud and they steal money under false pretenses. Just the fact that Lulu.com refused to move forward and print my book should have voluntarily refund my money. In order to sue Lulu.com/Lulu Press, Inc/Lulu Enterprises, Inc, I would have to hire and attorney in NC. or go there for two trips to file in small claims court. Either way it is not cost effective. The two people whom I talked to were Danny Hale and Stephanie Frame. Neither would respond to emails nor phone messages.

I have found another publisher and they told me that they have heard bad things about Lulu.com. However, when they looked at my manuscript, they informed me that copyright laws did not come into effect until about 1933. Therefore, the photograph is exempt from the law. My book is published and I am selling them. But no refund from Lulu.com, etc.

SAINT JOSEPH, MI-A complaint filed on June 4th, 2015, alleges that over $280,000.00 in accounted-for royalties owed to Nannette LaRee Hernandez, author of the book “Creative Screwing: a woman's guide to becoming an erotic enchantress of superlustful sex,” were converted by Alan Leddon dba Spero Publishing and his co-publisher, LULU.com, through the years 2012, 2013 and 2014.(Nannette LaRee Hernandez v Alan Leddon dba Spero Publishing, Rebekah Leddon, LULU.com, LULU Enterprises, INC. LULU LTD. Case No. 15-0121CB)

In October of 2013, Hernandez filed a police report against Alan Leddon for fraud. Leddon admitted to the police that he had converted all of Hernandez' royalties and never paid her according to the publishing contract. Hernandez filed suit on September 4, 2014, only to be stonewalled repeatedly by Leddon's refusal to turn-over documents and information, and by his denial to the court that he had any royalties in his possession that were owed to Hernandez.

Hernandez' attorney, Rebecca Sanford, subpoenaed LULU, the co-publisher of Hernandez' book, only to have her subpoenas ignored until Hernandez went to the New York Times and then threatened to sue LULU if LULU did not provide the subpoenaed documents and information.

Under pressure, Kathy Hensgen, SVP Operations at LULU, admitted to Attorney Sanford in an email dated May 4, 2015, that LULU had set-up a second account in the name of Leddon's wife, Rebekah Leddon, and that all Hernandez' pertinent sales data for 2012, 2013 and 2014, had gone into that account, and that Hernandez' royalties were paid to Rebekah Leddon, from LULU via Paypal.

On May 19, 2015, at a Summary Judgement Hearing against Alan Leddon, Attorney Sanford requested that the court dismiss the complaint against Leddon so that Hernandez could re-file a combined lawsuit against LULU.com, Rebekah Leddon and Alan Leddon dba Spero Publishing, siting conversion of her royalties and fraud under the Uniform Fraudulent Transfer Act, and alleging that LULU had funneled her royalties to Rebekah Leddon with the intent to co-conspire, contribute and assist Leddon in his fraudulent scheme against Social Security and the IRS, so that he could obtain free benefits, while he and LULU converted Hernandez' royalties.

Hernandez' complaint asks for 3x the amount of the $280,000.00 in unpaid royalties and an additional 3x the amount owed to her in royalties, for Breach-of-Contract, Misrepresentation, Conspiracy, Unjust Enrichment and Fraud under the Uniform Fraudulent Transfer Act. Hernandez also seeks punitive damages.

I have contacted LULU several times in the last two months both to the costomer service and the legal department. I recieved two emails from customer service and non from legal. I provided my phone number but only recieved emails from customer service and no calls I still have no book files. I was told unfinshed projects were deleted after 120 days. But my books have been finished and pubished.

One of my books'The Up Side of Being Down," has been on file and published for over 4 years and on file at the Libary of Congress and copy righted. I would like to edit another book I have Called,"RV Living Living By Design Book One," but no book files. This company is a joke! Stay away!
