We bought a brand new home from meditate homes in 2013. First off we went to check home out as was being built. The water was spraying all over the place after the sub contractors went home. I rushed to meditate salesperson and he went shut it off. The wood was soaked. They let it dry and kept building.

Next they made mistake in our cost of home and they owed us 2000.00 dollars said they would pay us the remaining and didn't so we went in the hole financially.then they played ourwood floors when it was coldest at 18 degrees out. It was like fighting tooth and nail to get them to replace it as it kept bubbling up during the summer because when they laid floor was too cold for glue to seal.

Now just recently our closet shelf was half full and collapsed on the floor all on its own. I took a picture and there is a lawsuit going on against meditate right now for cheap building.

Dear New Construction Home Buyer:

I am addressing this matter to you with the purpose of making you aware of the deceptive, unethical and negligent practices of Meritage Homes as a developer, builder and seller of communities in Florida and other States. The unresponsive and unethical Corporate Culture and negligent behavior is demonstrated from their Board of Directors to local Region President as extensively documented including some correspondence below. I am not aware if these deceptive practices are exercised only against senior citizens - just for the purpose of bleeding them of emotions and of course more money - or if it is a common practice for all unaware buyers. My wife and I are proud Florida senior citizens and when we refused to yield to their deplorable practices, Meritage Homes overtly decided to retaliate against us (see correspondence below).

Dear Meritage Homes Ethics Committee - We are surprised not hearing from anyone in Meritage Homes Ethics Committee. We doubt that for a Public Company like Meritage Homes, the Code of Ethics would be just a paper-thin meaningless document. We also thought that the Meritage Homes ethics committee may be misdirected by one sided falsehoods from affected personnel in our report. Just as a quick example below, we include our reply letter to Meritage Homes the same day that we received via email in Minnesota, December 5th. This sole ultimatum letter requested to return in 7 days bogus documents and of course not in our possession. As of today, this letter was not answered and requested documents were not provided for our review, our attorneys review or of course our signatures (impossible to meet sole ultimatum letter). The complete letter is below, but I only offer the following and very clear request that day in order to comply with ultimatum. Instead, we received our earnest monies back early January:

“…C. Finally you also indicate that we need to provide all documentation requested by XXx by 12/12/14 in order to avoid the application of A and B above. Please indicated what is “…all documentation requested…” or send us additional copies since we do not remember receiving any of all this referenced documentation…”

I hope you can easily understand that Meritage Homes Orlando never had the intent of making good on the offered Home/Lot contracted combination mistake settlement. Thank you,

In the second email, I was able to open the .pdf file (titled Final Default) containing your letter of same date. Unfortunately, it seems you are not familiar with facts and circumstances. I just send you the following comments that could help you get more familiar or request internally more of the facts:

You also site Page 11 #B of Lot 22 Agreement - Some remedies for Meritage because our lack of timely decisions or our written or oral request indicating our lack of intent to fulfill the contract. Since we have not provided any written or oral expression to this effect, we imagine that it is due to the design selections associated with the problem described in A above and related to same lot 22. If we are missing something on what you expressly include in your letter, let us know since it does not apply.

Finally you also indicate that we need to provide all documentation requested by XXX by 12/12/14 in order to avoid the application of A and B above. Please indicated what is “…all documentation requested…” or send us additional copies since we do not remember receiving any of all this referenced documentation.

Dear Mr. XXX - I am unaware if the email that my Realtor received this morning; from Orlando Meritage Homes is your organization’s answer to my report? My Realtor is afraid/unwilling sharing this email with me, but basically he indicated that Mr. XXXXXX Meritage Homes Division in Orlando - as retaliation for the report below - would never sell me any homes at any price (Realtor said that my wife and I were blackballed). My Realtor is also afraid of potential retaliation against him and prefers not to be any longer involved in this transaction. It seems that the proverbial “injury” of selling me the wrong single story Arcata home in Lot 22 and waiting awhile to find out of the fit problem during permitting is now followed by the fake commitment to honor the deal in a different lot (Lot 72) - first “assault”. Now is also followed by this additional retaliation “assault”. All is just because we did not take the blame of Meritage Homes Orlando poor planning and other relevant misrepresentations (and just agreeing to get our earnest monies back). I believe RETALIATION is also covered in your CODE OF ETHICS. As before, sorry for the distraction and for whatever reason may prevent Meritage Homes benefiting from these reports. We would appreciate your confirmation that Meritage Homes Executives and Board agrees with Mr. XXXXXX double retaliation actions and there is no other fair solution at hand. Dear Mr. XXXX - it is unfortunate that I have to distract you and your team with this simple matter. I believe it is of benefit to Meritage Homes to learn of this very irregular situation since I consider it a violation to your Meritage Homes CODE OF ETHICS and most basic fairness. I already reported some of this matter to “The Network” (report # 120897509) and the following developed since my report (please see copy of related email below):

Due to Meritage Homes Orlando fake intent to fix a sold home and lot fit situation (misrepresented fit per signed agreement) Mr. XXXXXC wants us to pay an additional amount of over $25,000 (estimated only because per message below he refuses to provide detailed new pricing)

The lot fit problem was for lot 22 of the Enclave of Windermere Landings

Mr. XXXXX also refused to seek at the time Meritage Homes or local authority variances for this 2-3 feet problem

Offered, but never documented, Lot 72 represented a partial satisfactory alternative for us since we would prefer the original lot 22

Both lots are still available, but Mr. XXXXX refuse to meet the offered pricing solution unless we pay considerably more monies (total estimated at $25,000 - per above)

We are willing to proceed only at the originally contracted or offered alternative pricing since the home/lot misrepresentation was not our doing nor we had control of available variances

My wife and I remain available for any additional clarification on this simple matter. We also very much appreciate your attention and apologize for the distraction,
