Our company has verified used equipment purchases through National Equipment Register(NER), which offers a product/service known as the IRONcheck report. As clearly stated on their website, the IRONcheck report is intended to “Protect yourself from the risk of buying stolen equipment with IRONcheck from the National Equipment Register (NER).”

On March 7, 2014, I requested an IRONcheck report on a CASE 580 L 2WD backhoe, serial number JJG0220741. At 12:25pm, an NER analyst, annotated there was a UCC sale record on 8/7/1995 of Plymouth Meeting, PA and explained the machine was “clean”. Clean meaning not stolen.

Based on this clean IRONcheck report, we proceeded with the purchase of the backhoe. We then sold the backhoe to our customer who in their attempt to export the backhoe was notified by US Customs it was stolen and subsequently seized.

The backhoe was released to the original owner and our company is currently in a loss of $17,000.

NER offered no apology or concession for their mistake and indicated that any requests for reimbursement of expenses/losses would be met with minimal response. Our company has been NER's strongest advocate; however, NER's actions clearly indicate they place zero value on their customers.

Mistakes like in this complaint can have crippling affects on a small business like ours. I have all supporting emails/documents that prove all statements in this complaint.

NER is a subsidiary of Verisk Analytics, which is a publicly traded company. "Verisk's mission is to help risk-bearing businesses understand and manage their risk."

The Ironcheck is marketed to reduce risk period. NER was negligent in their reporting and refuses to accept any responsibility for their mistake.

An attorney has advised us that we do have a valid case for Negligent Misrepresentation; however, this type of case we cannot sue for attorney's fees. Based on this information, it is simply not cost effective to file suit. However, we intend to raise the level of awareness of this negligent misrepresentation so that we can help prevent this happening to someone else.
