NG Tech violated several labor and employment laws and are daring me to go to Dept of Labor. I have not been paid in 2.5 months.

I was lured into the company by Lalit Deo, CEO of NGTech with the story that he was an upcoming business who wanted my expertise in Supply Chain to build out his supply chain practice and bring new business to the company in April'09. He started the hiring process for me in May and gave me the position of VP of Supply Chain and new business development. He promised me the job at $100,000.00 + expenses and started the H1 transfer process. After a couple of weeks, he told me that I should start looking at a bids site and start making proposals for NGTech which I did. I even submitted a proposal to State of Utah as the VP of NBD on behalf of NGTech. While I was working on several proposals, I started getting worried since they hadnt provided me a receipt of H1 transfer for over 1.5 months.

After many phone calls and voicemails, Kavitha in HR came back to me and told me that the application wasnt complete and they needed more information from me. I was aghast, it had been over 2 months and my H1 wasnt even processed yet! The CEO came with an excuse that he needed me to pay for the transfer which would be refunded once I start getting paid. They asked me to pay $3400 so things could go smooth. Anyway, I paid that and also collected all information for my H1 immediately and sent to them and subsequently they started processing it which took almost 3 months.

Once my H1 was transferred, their tune changed. They said that their venture capital funding wasnt in place yet so they would like me to find a job and become billable as a consultant and once the funding came, I would be offered the VP position. I found a project soon after but then they came up with a whole set of "employment agreement" documents that I was required to sign for them to consider me an employee which was never revealed to me for the first 3.5-4 months.

I refused to sign it ofcourse because now I started suspecting their intentions and the agreement was so out of the ordinary, violating not only our verbal agreements but also First amendment rights.

Now they are holding my H1 and my billing dollars+H1 transfer fees and I havent been paid for the past 3 months. We reached an agreement that they would transfer my H1 and we will part ways but they are not helping in that either. No one answers my calls or responds to my VM or emails.
