In March of 2014 I moved to the St. Thomas Virgin Islands. I contracted a company named Omega shipping to ship all of my household goods. At the same time I set up an insurance policy with Seaport Marine Insurance Company. When I set up the insurance policy I did a few things to protect myself. 1. I took detailed pictures of my highest priced items to show that they were in immaculate condition and sent the detailed inventory list along with the pictures to the shipping company to submit to the insurance company prior to the professional movers coming to pack all of my items as was outlined in the insurance policy. 2. I wrote out a detailed inventory of how much I paid for my items and sent that as an excel spreadsheet prior to the professional movers coming to box all of my items as was laid out in the agreement. I also took out a $200k policy to cover all of my goods at the cost of $6k. Prior to anything being boxed and or prepared for shipment.

On March 17, 2014 the movers came and moved all of my household goods. They documented everything that they packed and didn’t make any mention of any defects of my goods. Then they shipped them to St. Thomas. A month after we had been in St. Thomas the goods arrived and the moving company on St. Thomas stored the items until we found a permanent residence which was about an additional 30 days. It is important to keep in mind we worked with our shipping company to maintain our insurance coverage on all of our household goods until it reached our final location and was delivered and set up.

We moved into our new home on March 28th. When the movers brought in our furniture a lot of our furniture was damaged, massacred and mangled. While the movers were unpacking our furniture I was taking pictures and contacting my moving representative and telling her how much of my stuff had been damaged. She said don’t worry that’s what the insurance was for and it would all be taken care of.

After all of the damage had been assessed I worked with my rep to figure out what to do next. I was told that I had to hire a surveyor on St. Thomas, pay them to survey my items, take pictures, and write up the reports etc. before anything could be done. I was already pissed that so much of my furniture was damaged and the fact I was expected to pay someone to survey my items on top of this was ridiculous. I worked with my shipping company who ended up paying for the surveyor’s services on my behalf. All of the information was submitted sometime in July.

I was in constant contact with the insurance company regarding the status of my claim and they kept telling me the same thing it’s with the underwriters. Finally in October after calling, emailing, and leaving messages for about 2-3 weeks with absolutely no response I reached back out to my shipping company and asked for their help. They informed me that they had been having the same amount of trouble contacting the insurance company as I had been having and only after threatening them with a case to the BBB did they finally respond. The following day I receive a RIDICULOUS offer from the company which doesn’t even begin to touch the amount of damage that my household good sustained. In essence it was a slap in the face. The company tried to send me a long explanation about why it didn’t cover this and that. When I asked the company why did they even require me to solicit a surveyor if they weren’t going to honor their recommendations and that I was going to file formal complaints with numerous websites and individuals about their shady business practices I was told that their lawyer would be contacting me. I told the woman fine, you can’t threaten me for telling the truth about this situation.

I have all of the records from this transaction dating back to before my items were shipped. The surveyor read all of the rules and obligations listed in the insurance companies “policies” and his recommendations were based on restoring my household goods to their former state not based on replacement value which is what I really wanted. The insurance company wouldn’t even honor that. They went so far as to offer me percentages of the restoration value which I found to be completely outlandish. In essence they were discounting the price even more because they didn’t want to pay me. I have been fighting tooth and nail just to get what’s owed to me especially on my big ticket items.

According to their policy they don’t cover electronics yet the shipping company lost my daughter’s karaoke machine. It never states anywhere in their paperwork that if something is lost that it isn’t covered… They considered it an electronic so it didn’t meet the criteria. They are doing all types of shady business practices that need to be reviewed.

I was forced to hire a professional surveyor to assess the damage of my household items and they still won’t honor the recommendations. I have everything in writing and I will be uploading them for your review.

After being nice for months today I had the last straw and found that the company thought that they could continue to walk on me which prompted me to reach out to the BBB for some help. I was supposed to be awarded $7,031 according to the surveyor yet these people want to offer me less than $2,000. There is no justice in that and I would like them to be held accountable.

Please be ware and do not engage into any business practices with a company name Seaport Marine LLC and Mr Bruce Bickoff. Seaport Marine LLC and Mr Bruce Bickoff "appear," represent and carry themselves in a very professional manner. "APPEAR" being the key word here. Seaport Marine LLC and MR Bruce Bickoff = SCAM and FRAUD. This is something we have to learned that hard way. After our newly structure company carried business with Seaport Marine LLC for over 18 months. Seaport Marine LLC and MR Bruce Bickoff provided insurance for transportation via his underwriter . After hundreds of shipments, insurance policies issued and thousands of dollars paid for each insurance policy issued to Seaport Marine LLC and Mr Bruce Bickoff, there were a few claims that occurred while shipments were in transit. All of the allege claims were are closely monitor in order to ensure that any possible claims are legitimate.

After reviewing the claims and gathering the necessary and require documentation in order for a claim to be file with Seaport Marine LLC,

the gathered documentation, information that were provided in each of the claims to Seaport Marine LLC and Mr Bruce Bickoff were:

pictures prior to loading

pictures after loading

pictures before unloading

pictures after unloading

destination condition report

estimate repair report issued at destination

copy of insurance policy issued by Seaport Marine underwriter

The above information and documentation was provided via email, via fax, via USPS time after time. We follow up our emails, communication, letters, via telephone in order to ensure that all the proper documentation and requirements were met so that the claim could be process, resolve and settle with the customers. Seaport Marine LLC kept claiming that they did not receive proper information, documentation in order to file or proceed with the claim. As time passed on, our company started doing more research in order to find out why Seaport Marine LLC and Bruce Bickoff were not responding and taking proper action in order to settle the claims. We managed to obtain / locate the information for some of the actual insurance carriers known as the underwriters from some of the polices that were issued by Seaport Marine LLC. We immediately contacted the underwriters that we located information and such underwriters were:

Lloyds of London, and they requested the information above in order to file a claim. After the underwriter received such documentation and information they informed us that Seaport Marine, LLC never reported nor presented any of the policies to LLoyds of London, nor pay for any insurance premium / fees due to Lloyds of London for issuing said policy. The underwriter requested a copy of the payment from our company to Seaport Marine, LLC. We provided with such copies of payments from Our company to Seaport Marine, LLC. Basically, Seaport Marine, LLC and Mr Bruce Bickoff were collection funds for insurance policies issues and never paid the actual underwriter for said policies and committed FRAUD and STOLE FUNDS from our company as the policies nor claims were never paid.

Below you will look at the latest letter communication provided to the California Insurance controller in order to try to resolve this matter in a professional manner.

In regards unsettled claims Seaport Marine, LLC has not been able to resolve. Your reference file RUS-6834876.

We have spend time gathering all the evidence and documentation that has been provided to Bruce Seaport Marine at the time the claims were open with him. (Please see attached spreadsheet with claim numbers and specific tabs) Again all we are looking for is a resolution for the unpaid claims to Direct Express and our customers.

Regarding your letter concerning Mr. Bruce response dated September 5, 2013. Please note that we would like to make you aware that as of today 02/06/2014 we Direct Express, Inc have not received any refunds, settlements or payments in regards to the claims submitted to Seaport Marine LLC, nor have any of the customers that Direct Express, Inc has filed claims on behalf of.

Please note that we would like to request to receive the settlements "funds" on the claims submitted to Seaport Marine via California Department of Insurance; as we do not feel comfortable with the business practices, conduct and business ethics from Seaport Marine LLC. We would like for Seaport Marine to pay all the settlements / claims to California Department of Insurance and then we would like for the California Department of Insurance to forward such funds directly to customers or to Direct Express, Inc. In this manner we can properly settle currently pending claims to our customers and reimburse monies paid by Direct Express Inc for unsettled claims to our clients, who were unethically ignored by Seaport Marine LLC.

Seaport Marine has written a previous letter stating that there is one open policy for Direct Express, Inc which they mention to be: B2002LMBR05345

We have learned that there has been two policies under Direct Express, Inc. We do not know if there might be more open policies or more underwriters that have suffered or are suffering / experience the same situation as the below, as Seaport Marine was the company opening such policies on behalf of Direct Express, Inc.

Polices that Direct Express, Inc is aware of as of 02/06/2014 are as follows:

it seems that this Policy has been issued by Marine Cargo Underwriters LTD / John Cahill.

The policy was open from March 1st 2012 till February 28th 2013. Mr John Cahill is stating that he did not received any insurance policies since November 2012 for Direct Express, Inc shipments.

All of the policies were issued by Seaport Marine under policy number: B2002LMBR05345

Mr. John Cahill is also stating that Seaport Marine has not paid premiums for polices issued under Direct Express, Inc for which Direct Express, Inc has paid to Seaport Marine. (We have already provided California Department of Insurance with full payment history made to Seaport Marine)

Mr. Butler is clearly stating that it has not receive any premium from Seaport Marine on the policies issues on behalf of Direct Express, Inc / for which Direct Express, Inc fully paid to Seaport Marine. (already provided full payment history to California Department of Insurance.

Mr. Butler is also stating that it has not been informed by seaport Marine of any claims issued under policy B110200611242.

Mr. Butler informed us that the policy coverage began March 2013 and ended on August 21st 2013 .

the amount of 1294.61 USD. Seaport Marine has received payment from the underwriter and Seaport Marine has not paid Mr Christoph Schell and nor Direct Express, Inc for such settlement.

We have also been informed that claim # 13022711331 has been paid directly to Mr Jorg Roger Valentin for the amount of 1828.40 USD directly by the underwriter.

As per previous email communication Direct Express Inc and its representatives have been in constant communication with Seaport Marine LLC trying to obtain a solution or resolution to the unpaid claims our clients have submitted.

The continuous request to try to resolve insurance settlements claimed by Direct Express Inc insured's has been unsuccessful.

Direct Express, Inc has followed all the necessary steps and provided requested documentation for claim settlements via internet and email. Direct Express, Inc provided bills of ladings, condition reports, dock receipts from origin stating the condition of the vehicle, dock receipts from destination stating the condition of the vehicle, pictures from origin clearly indicating the condition of the vehicle prior to shipping and pictures from destination clearly indicating the condition after arrival. On such dock receipts and pictures, you will be able to clearly identified damages that occurred while in transportation. Information submitted clearly shows that damage occurred.

In addition, we have also provided estimate repair reports via email in order for the claims to be process by Seaport Marine.

These issues has been dragging on for more than 2.5 years now and it clearly shows Seaport Marine LLC is conducting unethical business practices and they are not looking to resolve this matter with Direct Express Inc.

It is our intention to provide honest and accurate information in regards the events that occurred during our business transactions with Seaport Marine LLC.

The unprofessional manner in which Seaport Marine LLC has conducted business with Direct Express and its clients, is the reason why your involvement has been requested.

We will be attaching a very detail spreadsheet that will clarify each situation on each of the claims with customer name, by certificate number, policy number , claim number and our bill of lading number.

it will also reflect that Direct Express, Inc has already compensated customers for the claims as Seaport Marine did not take any action at all, after all proper documentation, pictures and back up has been provided via e mail and via internet.

as of 02/06/2014 Direct Express, Inc has settle with customers directly for the amount of : 7458.89 USD

There are many claims that remain open and as of today there is zero communication between Direct Express, inc and Seaport Marine LLC.

We would like for all of the claims to be properly handle and resolve in a timely manner.

Again, based on previous history and unethical business practices that Seaport has shown to conduct and continues to do so, we would like to request that Seaport Marine LLC resolves the settlement of "funds" via California Department of Insurance as we do not feel comfortable with the business practices, business ethics conducted by Seaport Marine LLC. We would like for Seaport Marine to pay all the settlements / claims to California Department of Insurance and then we would like for the California Department of Insurance to forward such funds directly to customers or to Direct Express, Inc.

We believe this is the only way all the transactions will remain clear, full of integrity , extremely visible for all the parties involved, leaving no room for Seaport Marine LLC to continue to take advantage of the situation and misrepresenting underwriters.

Seaport Marine LLC continues to take advantage of the situation and misrepresenting underwriters, worldwide. Our company and its representatives have been in constant communication with Seaport Marine LLC trying to obtain a solution to the unpaid claims our clients have submitted.
