It is clear now that his intention from the beginning was to buy the loan from jeff bank and foreclose on the Inn with intentions that he and his friend ollie would profit from his buyout.
After a few weeks negotiating with the bank he asked me to send $15k to the bank so they would hold off a foreclosing proceedings. "this is the best deal i can get. i suggest taking it. wire the money immediately and we will have time to do the buyout in january. joe" i refused stating it made no sense. the next email stated
"The $15k is for guaranteed loan approval. it fact it is guaranteed a 100% that it would be approved it is just a paperwork problem" Immediately following he purchased the loan from jeff bank and started foreclosure proceedings. the $15k would of reduce the payment so he paid less, not guarantee a new loan.
two years later no judgement has been filed. i recently found a buyer and offered sfr funding amicable settlement and he has refused. he has added unreasonable collections fees totaling $6740 when no collections efforts were made. in addition no transfer notices were given to me from jeff bank or sfr funding. property taxes are due and he has been asking me to pay them and than he would settle. I stated lets put our settlement in writing and than i will pay. his lawyers Brian Rourke & John Theodore stated they could not do that because there were paperwork problems. Than came another email from Joe that stated. "SRF FUNDING has first lien we get ALL. YES ALL our money when it goes to auction FIRST so there is no financial reason to take anything less for any reason"
this is one of his latest response after i sent yet another amicable email offering settlement & a karma quote "I am an atheist screw karma. i will meet your buyer on the courthouse step and he will buy it for $280,000 SFR gets its money you get karma."
