On 06/24/2014, I saw a listing on HAR.COM for a condo that was available to lease. The unit, located at 5523 1/2 Pine Street, 77081, was listed as being available to lease for $625 a month. After a few phone calls between myself and Betty Townes (realtor), a showing of the condo was arranged. Betty and I met at the condo on 06/27/14. Being satisfied with the condition of the property and the advertised rate, I filled out a rental application provided by Betty Townes.

On 07/02/2014, I called Betty Townes to inquire about my application and she confirmed my approval. She said that the landlord/ property owner (David Dexel) would like to meet with me and explain to me some issues regarding the property. Ultimately, the three of us agreed to meet on 07/04/2014. After a short walk through and a bit of discussion regarding the move-in date, Betty Townes, David Dexel and I all agreed that I would meet Betty Townes on 07/11/2014 to give her a deposit of $625 and to sign the lease (which needed to be amended). David instructed Betty to re-list the condo or find another tenant if I failed to deliver the deposit and signed the lease on the agreed upon date. All three parties had an agreement in principal. As a result, I stopped loking for other units to lease and began to make plans to move.

On 07/09/2014, I received a call from Betty Townes stating that the condo was no longer available and that the landlord had received a "better offer". I called David Dexel to confirm this change in our agreement and he seemed unconcerned with damage he has inflicted by putting a "hard inquiry" on my credit report and leading me to believe that I had a condo secured only to then deny me. At no time during any previous conversation did either Betty Townes or David Dexel make mention of the cost of the lease being too low.

I will be filing a complaint with TREC regarding Betty Townes and I will also be looking into filing a complaint with the State Bar of Texas as David Dexel is and attorney and the ethics of his actions regarding this failed transaction leave much to be desired.
