When I was hired as an over-the-road truck driver, I was asked if I'd rather be a W-2 employee, or a 1099 Independent Contractor. I chose 1099 Independent Contractor, so that I could file my own taxes. After the first of the year, I had not received my 1099. When I asked the company owner (Curtis Paul Plunk) about the matter, he explained that his accountant told him he couldn't issue me a 1099. I asked about receiving a W-2 so I could file my taxes, and he told me that for 2013 and the first half of 2014, he was NOT going to give me a 1099 or a W-2, but that he was going to report my wages as "maintenance and breakdown/recovery costs".

I was employed by Mr. Plunk (Triple A Transportation) from November 19, 2013 to July 6, 2014. I have still not received a 1099 or W-2 as of this complaint, and he is refusing to send my final paycheck. He has also threatened me with physical violence on three occasions, creating an extremely hostile working environment. His willful refusal to withhold taxes is not only a bad business practice, it's against the law.

Being a small company, we were told to use paper logs, and were forced to "cook the books" as many times as possible to ensure the loads got delivered. My job was threatened on two separate occasions when I refused to operate illegally. I take responsibility for having driven outside of the Hours of Service regulations, because I knew better. However, I also needed the job to support my family.

I also know for a fact that the Motor Carrier Annual Inspection Form (for at least one of his three trucks) was "pencil-whipped". I know, because I was told that if I didn't do it, I could find another job, and that it had to be done so that he could "be legal to operate". He had also notified me that he wasn't sure that he was going to be able to pay his insurance, but that he'd operate anyway because he had to make money. By his own admission, he told me that both of his business accounts were negative "at least $4000.00", making it hard to pay the insurance. I also know that his other driver has not been reported to the insurance company due to issues that would make him uninsurable, or make the premiums increase.

There are mechanical issues with his equipment, too, that would cause them to be shutdown if they were ever inspected. Hence the reason we were ordered to bypass any scale as best we could. We've also been forced to haul loads that exceeded the 80,000lb GVWR, sometimes nearly 90,000lbs.

This complaint is being filed not only to bring light upon his illegal business practices, but to the unsafe manner in which he operates his equipment. I have notified the Better Business Bureau, am notifying the IRS, Office of the Inspector General (Social Security Administration), the Missouri Department of Labor, the Missouri Department of Transportation and have contacted OOIDA to assist me, because he texted me "good luck getting paid".

DO NOT WORK FOR THIS COMPANY.

We were in the U.S. Army together in the eary 90's and he claims to be my friend. I'd hate to be his enemy.

He's a manipulator, a liar, condesending and always tries to use reverse-psychology to get what he wants. I will not stop until he pays me what is owed, or he goes to prison for tax evasion/fraud.
