There was a flood in our apartment on Saturday April 4th at around 9pm. The washing machine stuck in a cycle and overflowed for 20 minutes until I finally was able to get it to stop. Before I did, it filled my kitchen, 2nd bedroom, bathroom and half the living room with two inches of water. Flowing underneath the cabinets and baseboards, into my garage and the neighbors garage. I was finally able to contact head of maintanance (HM) on the emergency maintanance phone after 2 hours. He was quick to get help from an outside cleaning service to soak up most of the water. They tore up corners of carpet and placed high pressure fans to dry up the rest.

This exposed the carpet pad, but also the very sharp carpet tack strips. By doing this, it stirred up dust, dirt and moisture causing the carbon monoxide detectors to siren. At this point HM disconnected all four units in the apartment.

By then it was 1230am and my wife, my two young daughters and myself went to sleep in the master bedroom. This was the last time anyone from the villas contacted me or came into the apartment for nearly 7 days. The carpet people came back every two days for a week, but left the fans and carpet strips exposed. With the floor exposed and air quality the way it was, the apartment was unliveable for 5 days. We stayed in a hotel for four nights and with my parents for 1 night. Once they pulled the fans and put carpet back down, it was still damp. As of Saturday the 18th, there was enough moisture in the air to leave condensation on the windows of a morning.

When we returned to the apartment on a normal basis, my daughters developed colds and progressed into upper respiratory infections that had to be treated with antibiotics. I feared for our health. I had to have my kids stay at my parents 3-4 times a week to avoid sleeping in the bedroom that took the brunt of the damage. I am a conductor for Bnsf railway and my wife is a cook at a local hotel. With two young children and work, our schedules are extremely busy. Through this catastrophe, I had to miss a days work and we were forced from our home for 5 days. My next issue and run-in with the Villas management only intensifies the situation and my discontent. On Friday April 10th, I called the office to find out when my lease was up and convey my intent to vacate the apartment, as we are building a house.

I spoke to a woman, who told me that I needed to have it in writing. I understood that, and asked if it needed to be done that day, or if it could be done on Monday. I was headed to work and would be at work out of town until late Saturday. She said Monday was fine. At no point did she inform me that my lease was up on April 30th, or that submitting the written notice to vacate was urgent. I stopped by Sunday, but the office was closed. On Monday I went in to sign the paperwork, and was informed that a notice had been put on my door. I knew nothing of this notice, and asked to see a copy. At this point I was informed that I was indeed late submitting a written intent to vacate form and that I had already been put into a month to month agreement at a 50% increase in my rent. I asked to speak to the manager, but he was not in.

The woman at the desk said she would pass along my information and have him get ahold of me. I also submitted my concerns of damp carpet, moisture in the air, mildew smell in apartment, and that the carbon monoxide detectors were still detached 8 days after the flood. A day passed, and I hadn't heard anything from anyone. Tuesday afternoon I went into the office and spoke to the manager and he said he had emailed someone above him to see if we could terminate the lease April 30th. At that point we discussed the supposed notice that had been placed on my door. I told him that I hadn't received anything, but that it wasn't uncommon for notices to blow away(as I live in a corner spot exposed to a lot of the TriCity wind). I asked him if he handed it to anyone at my apartment and he said no.

I asked him if had tried to call or email either my wife or myself, and he promptly told me he wasn't required to and that my original contract was enough notice. The tone of our conversation changed and I quickly realized he had no intention of helping me. I asked him to contact me directly as soon as he had any correspondence with whom ever was in charge of the decision and I left. Nearly 24 hours passed without any notification. I went back to the office, he was walking out as I walked up. I asked if there was any news and he rudely replied " I will call you tomorrow." I told him that I needed to know now, so I could find the resolution and figure out my next step.

I also mentioned That I couldn't afford to pay $1576 in rent for May, and especially in apartment that I hadn't been able to live in for a week. He told me that I was stuck and that I had to pay for month of May. He said he fulfilled his duty by placing notice on my door and that was more than he was actually required to do. I asked him, if he could afford to pay a $550 fee that was unreasonably placed upon him. He replied, "it's not my problem, it's yours." I honestly thought my lease was up in May. We had already started packing, and when the flood happened we packed up and moved even more stuff down to the garage. I never imagined things would work out like this. I finally stirred up enough attention that they send a carpet service to clean the carpets. Low and behold, they find mold in/on the wall and on carpet.

They cut the 3x2 piece of mold riddled dry wall out and replace it. But decide that cleaning the carpet is sufficient to eradicate the mold. I'm skeptical and ask them to pull the carpet up away from the wall, and they find mold under the carpet pad. Throughout this whole situation, not once do they suggest that it may be better for the health of my children to stay somewhere else. So here I am; my daughters age 6 and 2 recovering from moisture induced illness, short $290 in lost wages and apartment management that doesn't care. On top of it all, my rent increases from $1015 to $1576 for a smelly and damp apartment.
