The following serves to request payment for services not rendered and for the replacement cost of parts damaged while the vehicle was under your care, overdraft and NSF fees assessed by my bank.

On May 20th, 2014 I contacted Mr. Lino in order to inquire on his services as he was a personal acquaintance and my vehicle needed an engine replacement, he agreed to perform the services on my vehicle as he staffed two mechanics at his shop and knew a Toyota technician. Based on our conversation I agreed to have him pick up my vehicle from its current location on 2nd Street in San Jose, California to have it towed to Dos Palos, California.

Mr. Lino agreed to charge me $300.00 for towing to his shop in order to perform the repairs, $2,500.00 for the cost of the engine and $500.00 for the labor. Upon his arrival in San Jose, my 71 year old mother Ana L. Sanchez wrote a check for Mr. Lino in the amount of $2,800.00 to cover those initial costs. Mr. Lino cashed the check that same day. I received a telephone call from an acquaintance informing me they had seen my vehicle on a street in Morgan Hill. I did not suspect any wrongdoing as I trusted Mr. Lino.

Over the course of 65 days, I received various excuses, I was told that while working on the vehicle they had found salt on my engine and would have to flush the gas tank three times to ensure nothing would go wrong with my engine again. I was told that the engine they originally purchased did not work, that him and his mechanics could not figure out what was wrong and that the engine would be exchanged. The vehicle was taken to Tracy, California to see exactly what was going on. The vehicle was then brought back to his shop, however the engine was delivered to Tracy. I was also told Mr. Lino was awaiting to receive parts as some screws and sensors were missing. I was told Mr. Lino would be celebrating his wife’s birthday but assured me my vehicle would be repaired by my birthday which is June 23. I was told he was going camping. I was told my rear brakes had been repaired and a front bumper had been replaced pursuant to my request. I was then told that one of Mr. Lino’s tow trucks had broke down and he needed to repair it before he repaired my vehicle. On July 10th, 2014 Mr. Lino told me I would have my vehicle in the afternoon. On July 11th, 2014 I contacted Mr. Lino as I had not heard back from him. Pursuant to my request, he sent me a copy of an invoice depicting the purchase of an engine for the amount of $2375.00 with a core cost of $250.00. At that point Mr. Lino informed me my vehicle would be ready on Monday July 14th, 2014 and would be sending me pictures of the progress. I did not hear back from Mr. Lino over the course of the weekend. When he finally returned my call on Tuesday July 15th, 2014. He informed me his employees had quit on him and he had been so angry that he threw his phone on the ground and cracked it, therefore was unable to see or respond to my messages.

This is when Mr. Lino said he could no longer repair my vehicle and would be bringing it over to San Jose. He said he could bring it to a shop of his or my choice. Mr. Lino also told me there was something wrong with his head and he was going for an ultrasound at Stanford because his doctor’s thought he may have a brain tumor. Once I asked for him to bring it to a shop I know he told me he would not be able to give me the engine. I asked for him to bring the vehicle and the money which he responded he would not be able to provide me the money until he returned the engine. He promised to have the money and my vehicle on July 21st, 2014. As usual Mr. Lino did not keep his word. He did not return the vehicle until July 23rd when I informed him I had no choice but to report the vehicle stolen as he was refusing to return my vehicle. This is when the vehicle was finally delivered to 3398 Senter Road in San Jose, California. Mr. Lino knew he was supposed to deliver the money the same day the vehicle was delivered. Upon receipt of the vehicle we discovered several sensors were broken or missing, screws were lost, the bumper he told me he had replaced was still missing and there were no repairs performed to my breaks.

Over the course of that day, we received multiple excuses as to when the money would be delivered from in a little while to later this evening. As usual Mr. Lino did not bring the money. Based on Mr. Lino’s failure to perform any services we agreed he would refund the money in its entirety, this meant there would not be any towing fees involved. We agreed on having Mr. Lino deposit the money into the bank which he did not deposit until Friday July 25th, 2014 at 5:55 p.m., five minutes before the bank’s closing time. Upon review of the deposit I found out he had only deposited $2,500.00. I contacted Mr. Lino and he said the rest of the money would be deposited on Monday. I did not hear from Mr. Lino, I called him on Tuesday and his telephone number had been disconnected.

As of today it has been 71 days since the vehicle and money were delivered to Mr. Lino, this morning I found out the money or check Mr. Lino had deposited into my bank account had insufficient funds, leaving my account overdrawn.

I contacted Mr. Lino to resolve this issue and as usual he asked for more time because the company that had issued him the reimbursement for my engine had placed a stop payment on the check issued to him leaving his account with insufficient funds to cover the check issued to him.

This is my last and final attempt to obtain reimbursement from Mr. Lino. Due to his lack of professionalism, my family has not had a method of transportation to school or to engage in any type of activities. I am a single mother of two, I currently attend school to better my life and my children’s lives, this entire situation has been detrimental to my education and livelihood.
