I received a notice for garnishment from my employer today (1/10/14). It had included a letter stating that they received notice of wage /earnings assignment. The second page was a copy of a court order from Wooster, Ohio. The original debtor showed they were from Cuyahoga County Ohio. Now I must add here that I have never, ever received anything from anyone about any court date in regards to this. They are claiming that they served me papers at the Smithville, Ohio address in regards to this.

In looking at it closer I noticed that the address they had for me was one that I lived at back in 2004. (I should add here that I have been living in Pennsylvania since 2006). Please someone tell me how I can be served papers when I haven't lived in Ohio since 2006? And how was I to be at court on December 8, 2013?? I never even received papers here in Pennsyvania in regards to this. The first time I have heard about this is from my employer. Which produced a copy of this court document that I was never informed of.

The name of the original debtor is one that I have never heard about either. I told this woman that and wanted proof that this debt is indeed mine. When she asked what my current address was I gave her my PA address. (She didn't sound too happy about that one.) She went on to tell me that she would get documentation from the original debtor to prove this debt is mine.

In the meantime, I contacted the payroll office of my employer and informed them that I was disputing this and to not take any wages out of my check until I could get this cleared up.

My husband started doing research about wage garnishment in PA and come to find out PA will not garnish wages unless it is due to spousal /child support, or federal student loans so I am not able to be garnished.

However, the fact remains is this outfit is still trying to create false debt, and false court documents in order to try to take my money.

What bothers me is they are claiming this court hearing is legitiment and the debt is legitiment and if I still lived in Ohio, my wages would be taken.

I have also printed out pages of complaints on the company and I am seriously thinking about contacting an attorney. Who's to say they still won't try something else?
