I have been patiently awaiting an EEOC decision or letter from 08/2014 to pursue legal action, per an wrongfully terminated during an approved FMLA process. I have been suffering pain since I had to elect my previous employers (Sears)FMLA/UI process. I sought-out FMLA for my own personal injuries and have been completely ignored. I have been denied UI benefits, with several letters of appeals to rid this situation out of my control. DES of AZ has been rude and UN-professional and not adhering to their own, "Timely Manner" schedule. I have been provided time frames just to be lead astray. It takes days to speak to anyone and then you get the run-around. I have clear documents of all events that appropriately defends the topic. I can't get any financial assistants, or health benefits because of this dreadful case. This feels as if I am being badgered, the pain and suffering is becoming unbearable. Its hard to believe that after 4 loyal years as a above average employee with Sears, one gets treated this way.

My case worker and the attorney general provided me with information on obtaining a right to sue letter. However, the claim is still being investigated. I have been questioning Sears FMLA process for over a year now. Needless to say, the waiting is starting to break me down mentally/physically and I am loosing my mind. This case has caused a trickle effect and a battle for AHCCS/UI benefits. I have saved every conversation, emails and more documents to aide these concerns. I am jobless, car-less and about to be marriage-less. I can't hold on any longer and just need direction. I have spoken to several individuals, just to get pushed back. This case is beyond what I anticipated, but I am not tumbling. This case has been recognized by the Attorney Generals Office/EEOC and is moving forward, but my family is in need of care. Please don’t let these companies continue to bully their FMLA/UI(un-employment) claimants. DES AZ is facing it’s share of factual complaints and have already been in the current news reports. I have already filed a complaint with the EEOC for the entire process. However, would love to see DES and the Appeals team be held accountable as they wish upon others. Thanks kindly for listening.
