My concern and complaint is that Buy Squad, Inc., is engaging in deceptive marketing, sales tactics and sales, hence, at the least, fraudelent activities.

I purchased a 55 inch Samsung 3D, HD Smart TV from Buysqud. The product was “Recertified”. It was not a term noted on Buy Squad’s offer. When I discovered that the TV I purchased was “Recertified” I googled the term “Recertified”. and read that it was synonymous with “Reconditioned” or “Refurbished”. I cancelled my purchase. After my cancellation Mr. Mark Davis, a Buy Squad Customer Service Supervisor called me as to why I had cancelled. I explained the terms “Refurbished” and “Reconditioned” as they related to “Recertified”. Mr. Davis assured me that my TV was not “Refurbished” or “Reconditioned”, he said it had never been pre-owned. He stated that “Recertified” only meant the TV was last year’s model which had not sold and had to be returned to Samsung for their technicians to determine if it were still in ‘like-new factory condition’ and hence was “Recertified” (his quote) for sale.

I asked about the TV’s warranty. Mr. Davis replied the “ (my) Recertifed TV a carried a full one year manufacturer’s warranty. I asked if I would have any problems getting Samsung’s authorized service should it need servicing while under its ‘warranty’ period. Mr. Davis, said “not at all” and added that a relative of his had bought the very same make and model TV (that I had initially purchasedfrom him and cancelled), and that he had a problem with it and Samsung replaced his TV under the factory warranty. Based upon Mr. Davis’ title, with Buy Squd, and his explanations I then repurchased same said TV through him. I was later to discover that Mr. Davis’ explanation, regarding “Recertified” could not have been further from the truth.

Several month’s after repurchasing the TV I began having problems with the color and horizontal lines showing on the screen. This problem was intermittent. I called Samsung customer service and they told me I should change the TV Cable to an HDMI cable and that would eliminatie my problem. I changed the cable and the TV seemed to work but only temporarily and only for a short period of time.

I contacted Samsung. After a long drawn-out complaint to it, entailing numerous telephone calls and speaking with numerous customer serevice representatives in various countries and my multiple emails and faxes I was finally told by Samsung’s Executive Customer Service that the TV I had purchased was pre-owned, i.e., “Refurbished” and as such carried no Samsung warranty whatsoever. They noted the term “Recertified”, as described by Mr. Davis, was not in Samsung’s lexicon. Secondly, Samsung told me that Buy Squad is not a Samsung TV authorized dealer. Samsung would not discuss the matter any further.

I recontacted Mr. Mark Davis and explained what had my Samsung saga. Mr. Davis offered his apologies and said ‘he and Buy Squad would make things right’. Buy Squad’s byline in his emails to me assured me that customer satisfaction was their primary objective. Again, nothing could have been further from the truth.

Mr. Davis later notified me that he, himself, had contacted Samsung and that they were going to replace my TV. I replied that isn’t what they told me. Nevertheless, per Mr. Davis’ instructions I called Samsung (again), and related the information Mr. Davis provided me. Samsung denied what Mr. Davis told me and re-iterated what they had previously said.

I re-contacted Mr. Davis via email and he responded saying he would “get to the bottom of this matter and not to worry” reiterating that Customer Service and Satisfaction were all important to BuySquad. After two weeks and no further contact from him I re-emailed him.

I received a voice mail from him to call him. I tried several times to call him and I even left him a voice mail. I did not hear from him either via telephone or email, etc. Since that time I have emailed him twice more and still no response.

I now believe Mr. Davis, Buy Squd, had no intention of honoring their by-line of ‘providing customer satisfaction’. BuySquad had full knowledge that the TV I purchased was pre-owned hence “Refurbished” and that as such carried no Samsung warranty. I contend Buy Squad deceived me when they sold me said TV and continued to deceive and mislead me when I attempted to enlist their help in reparing or replacing my defective TV. I have since reported the above to the Attorney General's Office, Consumer Fraud Division, State of Oregon and am awaiting their determination in this matter.
