I recently attempted to cancel my gym membership after two years of on time payment. I was told that I would need to pay for the following month as a condition of cancellation due to the gym requiring a 30-day notice. I pointed out that I was giving 27 days notice and asked if the 3 days could be waived. The front desk worker said “No.” I signed the cancellation form that stated I would be charged for the following month’s dues as the gym employee stated it was the only way I could cancel the contract. On the way out I requested a copy of my contract and to my surprise, there was no “30-day notice” mentioned. I then called in and talked with the owner. I explained that I was giving 27 days notice but he still wanted the additional month’s dues. I then stated that the policy was not covered in the contract. He still would not work with me and went on to state that “I signed the cancellation policy and no one held a gun to my head.” I agreed that I had not been held at gunpoint in his gym but I had been lied to by his employee, as the additional month’s rent was not contractually required as she had stated. He still would not back down. In response I have reported the event to the State Attorney General and the BBB.
