I was employed as an on call security guard for Elite Show Services, Inc based in San Diego for over two years. Whenever I got an assignment, I showed up on time and guarded my requested post. I always got along with my fellow employees and supervisors. Whenever I was told to do something by my supervisors, I always cooperated. Sometimes there are lags in job placements. The last time I got work was in August and I noticed that most of the guards had changed to younger employees. The last time I was scheduled for work was at a horse show at the Los Angeles Convention Center. I was scheduled to work on a Monday and then the following Friday-Monday. When I showed up for work on that Friday the supervisor was laughing and said I was not scheduled and why I was here. I told him scheduling had scheduled me for that shift. The local manager in L.A. told me to call Human Resources in San Diego with a smirk on his face.

When I called Human Resources they told me that they had called me and left a message telling me I was on disciplinary review and my shift had been cancelled. I told them that no one had ever called me and I use google voice and all my messages were logged on my computer. They still insisted they had called me and refused to pay me the four hours that is required when you show up for work and are sent home. When I got home I was told I was part of a disciplinary hearing that would take place on that Tuesday and a decision would be made on Wednesday. I never received a call on Wednesday and called Human Resources on Friday. They said that the managers were busy and hadn't got around to my hearing. They always called it a hearing even though if it was a hearing I should've had a chance to defend myself. They also promised they would pay me the 4 hours and send it on the next payroll run. I recieved my check last week and I was only paid for the hours I worked on Monday and was not paid for the four hours.

Today I received a termination notice in the mail. The reason I was being seperated was provided on a checked box that read poor performance. The only time I was warned about anything was when someone reported me for looking at my cell phone while I was on post. I apologized and told them that wouldn't happen again. I was actually checking to see if my wife was ok, because she wasn't feeling well before I left for work. Also on the termination notice it says my signature was on file. I have never signed anything and they are lying about having my signature on file. When I returned to work in August, I noticed that none of the older employess around my age were working. Around 50-70 years of age and only younger employees in their 20's to 30's were working. Not only that there was one employee working there who I had seen listening to music on his cell phone and dancing around and yet he is still employed with Elite. Also at one job I had last year at the L.A. Convention Center I was at one post for 11 hours and got only one ten minute break. The supervisor had made an annoucement that day on our 2 way radios that under no circumstances was anyone allowed to ask for a break. I do admit that they did improve in giving guards their required lunches and breaks this year.

My complaint is in the way I was terminated and that I am a victim of age discrimination and not given any written or oral warnings before my dismissal. I reccomend that clients do not use Elite Show Services for their events because of their total disrespect of me and my loyalty to them when I was working for them. They want us to have a smile on our face and to be loyal to their clients, but they obviously haven't showed that to me and I suppose other employees that have been treated this way.
