Equipment Rental Source (ERS) in Castle Rock, CO

Don't honor contracts & communications

I rented a Bobcat compact track loader for a one week period (40 hour maximum), which after associated fees came to $1,488. I have rented from this company before and had problems with them but, since they are so close, I gave them another try. With the past rentals they charged me after the rental contract was up. This time they apparently charged my card before the machine was even delivered.

The Bobcat was delivered on a Tuesday. On Thursday afternoon, after just 20 hours of use, the Bobcat popped its track even though I was in a soft trench that was just 12 inches deep and driving forward in a straight line with a load. Mac Delbaugh, the manager, told me he was "understaffed" that week and so I'd have to "bear with him."

24 hours later (on Friday) I hadn't heard from anybody and so I called the office. I was told by the employee who answered the phone that he was the only one in the office and couldn't get out to me. Mac hadn't come in that day. To make matters worse, they're of course closed over the weekend (the main time I intended to put the remaining 20 hours on the machine). At no point did they offer to come out over the weekend anyway, and I was just left hanging. I texted them to let them know that I work during the week and so I really needed the weekend to use the equipment.

Mac told me he'd come and repair the track Monday morning. He instead showed up in the afternoon. I got a message at 6:15 pm that it was fixed, more than 96 hours after I first reported it to them (that's four full days of downtime, including the prime weekend timing I needed to use the machine). Even though I was working during the week, the first opportunity I'd have to use the machine again would be the following morning, Tuesday, and yet I was told they'd pick up the machine on Thursday - presumably giving me just 1 1/2 days to now get my remaining 20 hours in - because they had a weekend reservation on the machine. I texted them to let them know that I really needed the machine over a weekend, wouldn't be able to put much time on the machine before Thursday, and if that was their position they should just pick up the machine and PRORATE the contract (meaning charge me for 20 hours based upon the 40 hour rate.)

I never got any return message from them. Instead they just came and picked up the machine. Mac's Dad, Bill, then contacted me and said they needed to settle the account and charge me $73 for the gas they had to put in - gas I never had the chance to put in cheaper because they never called and instead just picked up the machine. UNBELIEVABLE!

I called Bill and he was adament that I owed THEM $73. I was in utter disbelief. He eventually offered to REFUND me $400. I didn't even know I had been charged the full amount up front, as they had never done that before. I shared that, per my text, the machine could be picked up based upon a "PRORATA" amount. So, instead, Bill said that he'd have to charge me a two day rate, meaning I'd have to pay $300 MORE than the prorata rate. AGAIN, UNBELIEVABLE, and yet he acted like he was doing me a favor.

I pointed out to Bill that my text to Mac stated they could pick up the machine based upon a prorata rate (otheriwse I would have kept the machine the measley 1 1/2 days they were going to give me to try to put some some more hours on it). Bill stated flat out "I don't care" and "If you read the back of the contract, I don't actually owe you anything." Did I say, UNBELIEVABLE?

Incredible, the audacity of some peope who are supposedly in a customer service business. Bill wanted me to accept the $400 refund (whoch shouldn't have been charged up front anyway), leaving me a cost of $1,088 (plus their exhorbitantly-price diesel) instead of the prorata $744. I told him that I wouldn't accept it because they picked up the machine under false pretenses and in direct disregard for the stipulation I communicated for them picking the machine up early.

They tried this on me before, when a tire popped off a skid steer in mud, which then popped of again in soft dirt, and they tried to charge me for the three days it took them to replace the wheel. They then charged me for the wheel because, after the second time the tire popped off the rim it went over a rock and damaged it. They just wouldn't accept that there was obviously something wrong with the wheel to begin with. I should have learned my lesson.

DON"T do business with these guys. They are not honorable men in my opinion!
