We contradcted wih Gary's Pool and Patio to install a pool, with constrution to begin in May 15, 2014. They promissed to construct a retaining wall and backfill and do some rough grading after the pool was installed. The entire process was to be completed in 3-4 weeks, and it was promissed no later than July 4, 2014. The pool and concrete was not done until August and Despite over 20 requests for information as to when the retaining wall was to be built, it has yet to be built (it's Decembwer 30, 2014). We ask almost eery other week, and are told someone would be out to measure (they ahve beeen out 3 times to do so), they claim they would do it themselves, they said they had hired a contrctor, all of which is false. It is now over 6 months since the project was supposed to have been finished, and today their manager just shrugged his shoulders.
As an attorney I have begun the process of suing them for fraud, breach of contractx, and violations of the Texas Decetive Trade Practices Act. However, I write this to warn others NOT to do business with this company. They do not stand behind their contracts, try to get you to pay for completion before a project is complete and don't want you to retain the amount (10%) for 30 days after the job is complete as required by Texas law. BEWARE!!!!
If anyone else has had similar issues with Gary's Pool, we would welcome your input into our lawsuit, the more folks we have, the better we can show that their conduct forms a pattern or practice for which punitive damages should be awarded to deter this kind of conduct.
