GIULIO FERRARI, 6) CET MOIS, 7) JULIO LYON.
Dear Mr. Burgess,
This letter will serve as our formal complaint against the above named company and owner thereof. All information stated in this letter is based solely on data we gathered from: 1) Lt. Marvin Gibbs, Division Commander of Community Services Department in City of Rowlett Police Department, 2) our conversations with Mr. Ferrari, 3) the contract composed by Mr. Ferrari, 4) Service Magic/Home Advisor [on-line referral service], 5) Sub-contractors [individuals and companies] employeed by Mr. Ferrari, 6) Sub-contractors [individuals and companies] unrelated to/not employeed with Mr. Ferrari, 7) the Pastor of First at Firewheel (Church), Garland, Texas.
Our decision to hire Mr. Ferrari was based on the following:
1) the recommendation of ServiceMagic.com HomeAdvisor
2) Mr. Ferrari told us he is a Pastor of First at Firewheel Church
In mid-October, we spoke to the Pastor with First at Firewheel, who stated Mr. Ferrari was not, is not and will not ever be a Pastor with First at Firewheel.
HomeAdvisor, formerly ServiceMagic, is a leading website offering comprehensive tools and resources for home improvement and repair projects. Harnessing 13 years of expertise helping more than 25 million people find a trusted home service professional, HomeAdvisor features the patented technology of ProFinder, showcasing the nations largest network of 85,000 pre-screened, customer-rated and reviewed home improvement professionals. Their screening process states We use third-party data sources to check the principal/owner of each business for bankruptcy filings, liens and significant state-level legal judgments during the three years prior to their enrollment in the HomeAdvisor network, and IDENTITY VERIFICATION: We verify the social security number(s) of the owner/principal for identity
check purposes. This check applies primarily to smaller business entities.
We became suspicious when we discovered Mr. Ferrari composed the contract and pulled the permit in two (2)
different names and addresses. The name/address on contract is GIULIO FERRARI, 8795 Preston Trace Blvd Ste 2 Frisco Texas 75033. The name/address on permit is JULIS FERRIRE, 1134 S Montreal Dallas Texas 75208.
Mr. Ferrari hired Rick's Excavation of Hutchins, Texas to dig the hole for our pool. Upon completion; the hole appeared unusually deep. We learned that Mr. Ferrari did not provide them a proper architectural drawing (which would have included the elevation level allowing for proper calculation of slope and bond beam). The hole was dug below
the foundation level of our home which will definately result in future problems with the foundation. In an attempt to rectify the mistake, Mr. Ferrari wanted and must have additional money to pay for additional steps inside the
pool and to increase the dimensions of each individual step to an abnormal and uncomfortable height. As of today, Rick's Excavation confirmed they were paid $1800 for services rendered at our address.
page 1/2 The City of Rowlett permit application requires names and addresses of the general plumbing and electrical
contractors intended to work at said construction site. Additionally, the City of Rowlett requires a Licensed Plumber perform the services related to the gas line. Mr. Ferrari hired Alfredo Jaramillo who performed all plumbing duties, including the gas line. Alfredo Jaramillo is; 1) an illegal alien, 2) not a licensed plumber, 3) did not work with direct supervision of a licensed plumber, and 4) is not the plumber listed on the permit.
For several weeks; the live electrical cables were laying [dangerously] on top of ground, not buried, as documented with a red-tag by the City Inspector.
Blake Scott, City of Rowlett Building Inspector issued 2 red tags for the following items:
-Red Tag Date October 9, 2012: 1) P trap not installed, 2) ground the mat steel, 3) clamps not secured
-Red Tag Date October 30, 2012: 1) need equipment ground, 2) conduit needs to be 18 deep, 3) need deck drain to
keep water from going into pool, 4) by gate needs to be 4 deep form up, 5) need chair, 6) need additional ground clamp
On October 30, 2012, Mr. Scott advised us to not pay any more money to Giulio Ferrari, he doesnt know what hes doing.
On October 30, 2012, Giulio Ferrari was arrested on our property for giving false identification to a Rowlett Police Officer. We learned at that time, from the officer that Giulio Ferrari doesn't have a valid drivers license and is an illegal alien.
We filed charges against Mr. Ferrari for fraud and theft of service with the City of Rowlett Police Department, case
number 12057413. The charges are considered a Felony due to the financial amount involved and stolen.
We paid Giulio Ferrari $21,000, for 1) services he did not provide; and 2) those provided were deemed inaccurate,
not according to the contract and most importantly unsafe. This amount includes $7,908 that the contract designated to pay for shotcrete (services performed by Texas Shotcrete) , concrete (services not performed) and tile (actual tile not received nor installed) and stonework/coping (actual stone not received nor installed).
However; today, November 27, 2012, we received a call from Texas Shotcrete regarding their (unpaid) services at our
address. Per their conversation with Mr. Ferrari, he isn't willing to pay the $4,800 outstanding invoice and offered his rental properties for which they can place a lein (which is illegal). As a result of Mr. Ferrari refussing to pay for services he ordered, Texas Shotcrete informed us they will soon place a lein on our home.
We've subsequently been forced to hire another company to repair existing portion and finish building the pool so
that it will function properly and safely, at the estimated cost of $12,000 - $16,000 [of which we've already paid $12,000]. Many of the new sub-contractors have expressed concern for the general manner in which every aspect of the existing pool were (so poorly) executed.
We request you take whatever means necessary to keep this from happening to anyone else. We intend to do
everything possible within the law to stop Giulio Ferrari from committing further crimes and be deported.
We submit this information freely, honestly and to the best of our knowledge. Enclosed is a photocopy of our signed
contract dated August 15, 2012, with Firewheel Pools and Outdoor Living. [omitted from public posting].
