I got two calls today, one on my home and one on my mobile phone. They both told me I was being served a summons on Monday the 12th of May for a ""bad check"" used for a payday loan in 2009. The bank they listed is one I had a SAVINGS account at, not a checking account, and I did not have any loan with anyone for a payday loan. The first calls come from 720-386-7022 (which, by the way, shows up as a number for a call center for Carribien living in Las Vegas....) and they tell me the case number, and give me the 888-778-6870 number to call.

Upon calling that number, I am told I will have to get the summons, go to court and probably jail. I told her (Ms Jones) that I am in chapter 7 right now, but that I do not have this debt and she told me (yes, this is a direct quote) ""We don't argue in this office, we don't care what you have going on, we don't care if you go to court or not, we don't care if you go to jail or not. People like you who write useless checks need to pay for your class 2 felony, and that means jail time. You cannot put a worthless check into a chapter seven filing (yes you can) and if you don't set up a payment with me, right now today, you WILL go to jail""

Never had a payday loan, did not have checks with this bank, she would not give me a physical address for the place she was calling from, or even a mailing address. She would not take the information for my attorney, told me she did not care anything about that and she did not know how anyone with a brain could file chapter 7.

I don't think I will sit by the phone and wait for them to call, or wait to be served papers (who has EVER heard of the process server setting up an appointment??) Anyone else have to deal with this company? My attorney tells me there are a few laws broken here, and we will follow up with it Monday.
