Great Employee, Victim of Slander Campaign

As a former supervisor of Jared for two years at the Federal Government, Jared upheld the highest standards of integrity, ethics, and morality. To get hired at the agency, he passed a sixth month background check and was on a fast track in the organization. It is a shame to see false claims as Jared notified us of a libel and slander campaign executed by a former boss. Jared left on great terms with us and was well liked around the office and I would recommend him to any employer.

In this fraud case :

I am even more shocked by Bank of America’s reversal of decision. They prefer to give the money to someone who they know has no rights to it, than to the account holder. But "they’re really sorry". At least something that would never happen in EU, banks (try to) help their customers, not ppl who steal from them and boast about it. I tried everything, lawyers, police etc.. but they would rather be sued by their client than not accommodate a fraudster.

The lesson is : If you need money, just get on a “signature card” of some company fraudulently, steal up to 100K$ bc that’ll cost the company more to retrieve the money; and voilà!

Obviously the decision the Bank made is extremely disappointing and raises various concerns on the lack of security of funds in general - if anyone with obvious malicious and stated intent chooses to abuse a right which is in itself hardly understandable, that is wiring company’s funds to his own personal account by stealing a debit card.

I eventually managed to have the initial decision and the one which was rescinded - despite Polites not being a signer on the account at that time, on July 3rd - sent to our address, not Polites’.

These will be added to the Prosecution files against him.

Would you please give me the contact of your Legal department: Polites was able to have his father-in-law, who may or not be an “attorney", speak to them, so I would appreciate the same privilege as the account holder.

Thanks Corey, I know you’ve been very helpful and reactive - I appreciate that.

On my end I also did all I could and was on the phone every single day, sent dozens of emails, signaled the transfer within the hour and long before it was even processed - this is a grave matter as besides my having to refund the company, this undermines my credibility as its CEO and comes at the worst timing of a round of investment. Prejudice would go way beyond monetary loss.

In any case Polites managed to eventually have the wire approved bc as of today he is still a signer on the savings account. Fraud and Customer Service did mention you should check with them that they do have the updated card:

To conclude this needs to be fixed ASAP, and the bank should recall the transfer bc he should no longer have been a signer on July 3rd.

I understand this kind of mishap can happen, he basically pushed every day, and at some point despite the freeze and the fraud warnings and resolution of the fraud case on July 2nd, he still managed to withdraw funds online (not in person)

But there are clear grounds for the transfer to be recalled and I’d appreciate you did what is needed for that.

Polites confessed to his wrongdoing to about 20 people and the signature card is not meant to be ostensibly abused as a tool to facilitate the actions of a self-proclaimed con artist. I am the President and CEO of Acme, Corp while he never even had an operational role in the structure -

and again there are surely cases where a partner gets fired and should not be able to run to the nearest bank and empty the company’s account onto his personal account. This could not happen in Europe but I am sure that in the US banks are also looking to protect their customers, and we know there is a latency period for the wire to be processed. So if I signaled it within the hour and it was stopped, if I proved he was unauthorized to perform it, he may have played a customer rep a week later.

He still won’t be able to produce a single document authorizing him to do so: an error on the update of the sign card can happen, and banks are able to recall transfers when the account owner demands it in the shortest possible timeframe.

Pls let me know if you need updated legal documents (police reports, prosecution memo, attorney’s briefs etc). Thanks so much for finally resolving this…

John ,

I sent up the signature to scanning as soon as I received the second clear copy back from you, I am looking at the faxed confirmation right now from July 3rd. As you know I have gone over and above to work with you, I.E. sent you signature cards and wrote back to as quickly as possible when the copies you sent me were totally blurry. I have the confirmation for the savings account being faxed up on July 3rd. I just left Desmond a voicemail as I’m not sure what is needed at this point, I certainly can show him the confirmation of the fax to the signature card area. He has left for the day it appears. I am working with you as much as I can to help but not sure what else is needed, I will await Desmond’s call back tomorrow and keep you posted.

Thank you!

Thx, hoping the analyst will end up getting back to me. But he sent confirmation that no wire had been processed on July 2nd.

The issue is that they confirm that the signature card has NOT been updated on the savings account, which you told me you did?

this is why Polites was able to actually process his wire on the 3rd of July.. and keeps changing the Primary address

counting on you to rectify the mistake and re-credit the wire ASAP.

They tell me you need to call in the call center to ensure that they can’t see the old signature card.

I obviously canceled the debit card which Polites stole and used to add his account.

Thanks for your help here, the fraud is abundantly clear and claimed by Polites and I understand that this mishap can happen, but I would appreciate it being settled once and for all.

Hi John , I am out in the field on client appointments today I sent the signature card to doc scanning same day you sent back to me which would update overnight. I would recommend calling fraud department and asking for a supervisor if you have questions as this is the area that handles this kind of issue, on the banking center I have to route clients to the fraud area. Thanks.

Dear

I assume some kind of mistake was made by someone who was pressured (see Polites email below).

However I believe there are strong grounds for Bank of America to recall that transfer.

First, could you confirm that Polites is entirely off the account?

I don’t understand why he can still change address etc - I don’t know, since the freeze does not seem enough, if we should keep the funds where they are, and if further risks are to be expected.

June 26: Polites is removed from a project unrelated to Acme. I confirm to him around midnight CET. He never had any operational role with Acme- as I explained to you, I (wrongly) believed that if something happened to me, it would be wise to have another person in the US to deal w the funds.

June 27: around 3AM EST, Polites who had planned retaliation, and had stolen my debit card, adds his personal account as beneficiary.

Proceeds to wires online with stolen codes and stolen debit card (I never gave him web access). I get alerted, call right way to freeze account, send you all documentation to have me as only signer on account.

A fraud claim is filed and I’m told the wires have NOT been processed and I stopped them in time.

July 1: by then, I understood I am he only signer. Originals have been mailed.

July 2 : after many exchanges with fraud, Fraud Analyst “Desmond Taylor” at 972 889 7915 confirms he “closes the claim and no loss was incurred since no transfer happened.” Confirms he will send letter to our address

July 3: I notice that Polites changed the address back to a place where he can receive the funds.

July 6 : I notice that a wire is eventually processed to Polites, who confirms he has been pressuring the bank to perform it. As sole account owner, I do not get any notification of a transaction signaled as fraudulent a week before.

I am not looking for BoA to admit to any wrongdoing, but to stand by its decision to acknowledge the conditions of the transfer were fraudulent and malicious, and to revert it.

Thank you for letting me know if you can help, and more importantly, if the account is secured as of today or not.

I told you my father in law was an influential lawyer, so when I advised you to drop it, you shouldn’t have wasted your time. I was gonna get my way with Bank of America no matter what, everything was planned well in advance.

That’s the price you have to pay, and I couldn’t care less about who this puts in trouble. I have investigated long enough to make sure you could not do anything in practice.

For once, you lost - and I advise you to stop wasting your time.

I don’t care about my reputation, I will resume a government job shortly and they won’t be checking Google.

Embezzlement /Fraud: deliberate and elaborate deceitful conduct prior to crime, fraudulent accesses to bank accounts

Identity Theft

Theft of Company’s Debit Business Card

Theft of Company’s Facebook Page

Blackmail and Extortion

Summary : While never a member, employee or Partner at ACME, Corp, Jared Polites proceeded to wire $4,602 from the company’s account to his personal account in/near Houston, TX. He also stole the company’s Business Card, which was canceled. Account was frozen.

He accessed the account alleging he was on the « signature card » and had stolen web access codes ; however, he had been explicitely and contractually prohibited from using any company fund for any reason, much less for his own personal benefit.

Polites managed to enter his personal account as beneficiary with the Business Card stolen from XXX’s wallet on June 26 when discussions about his removal from the unrelated project “Code Name” were conducted.

Polites was neither authorized legally nor technically nor contractually to perform any activity on ACME’s bank account, adding to the fact he acted under obvious malicious circumstances as a retribution for being dismissed – hours after said dismissal.

He proceeded with the wire the morning after (ca 9 AM) being officially terminated (the previous evening at 11PM) from a project which did not concern ACME, Corp.

He did not discuss this action, nor his termination, was absolutely unresponsive to emails and calls, until F. XXX received an alert at 1PM from Bank of America.

2 wires were also made from the account of J. YYY for a total of €2500 on the same morning ($3,400), access was available on a shared Google Doc, 1 for €1500 to Polites 1 for €1000 to Gothill.

These fraudulent wires had been planned since Monday, June 23; XXX notified all conspirators of the intent of an investor to invest in the project and create a company.

The reaction of conspirators was unexpected, insofar as Gothill convinced them that once the project would be funded, XXX would decide to hire more experienced and committed partners/employees. “Let’s take all we can before he gets rid of us”, one of their group exchange reads.

Indeed, Polites in particular had been notified on various occasions of his very poor performance and lack of commitment. He would come a few hours a day and spent most of the time chatting on various applications.

Likewise, the 3 co-perpetrators had no interest in the project and only stayed because XXX was “helping them with their rent”.

Each conspirator elected to invent various stories to convince XXX to pay them a cash advance for the whole month of June, which he agreed to by Thursday June 26 as he trusted them and saw the upcoming investment as a great opportunity. Polites received €1500, Gothill €1500, Tervizan €1000 on June 26.

However, XXX noticed that upon receipt of payment, all left abruptly, except for Gothill.

Hamra-Kroua also came unexpectly on June 26 to the office, arguing that she was interested in the unpaid internship opportunity discussed earlier. It turns out she was promised €300 in return for her help. All held the false belief that XXX would not pursue them as they heard that it might not be legal to work on a project while unpaid, or with “loans” such as these granted on certain occasions by XXX.

In fact, in France like in the US, anyone can decide to commit to developing a project which is at the very early startup stage; no contracts and “employment” relationship were ever mentioned. Yet the group believed they could somehow blackmail XXX, who they also thought “wouldn’t care about a dozen k€”.

XXX proceeded to terminate Polites and Tervizan given their behavior and altogether very poor performance.

Meanwhile, Gothill claimed he was very enthusiastic about the upcoming investment.

Jared Polites then explained both by emails and texts to Jordan YYY, a common friend, his criminal actions and attempted to justify them in a group email. He or the other conspirators refused any contact with XXX in a coordinated fashion, and remained persuaded “he would drop it”.

Polites notably issued a large number of threats, of all possible nature, since June 27, either directly, or through former friends. Polites’ parents also issued various threats, claiming to have enough influential contacts to deter XXX from prosecuting.

He subsequently fled the country for Sevilla, Spain, and returned on July 3 to Paris, in order to pack his belongings and prepare to return to the US (Houston probably where his family lives).

On June 27 at 9AM, concurrently to Polites’ wire transfers, his co-perpetrators Maissa Hamra-Kroua and Owen Gothill entered the apartment serving as a temporary place of work for the project and stole valuable items for an est total of €17.400 ($23,650).

Complaints filed with Paris Police Dept and the General Prosecutor of Paris.

Total stolen in cash from company to personal accounts : $8,000.

Given the unexpected, grave and violent nature of crimes, shocking abuse of trust, plaintiff suffers from psychological distress- was harassed, threatened, and durably disturbed in his professional activity.

Spent days with police and will seek all legal fees and damages beyond full restitution.

Constant amicable discussion attempts were all left unanswered by perpetrator and 3 accomplices/accessories to the crime or responded to with threats or various ways explaining XXX would be left “powerless”, since all had planned to leave France.

Investment opportunity was lost and project stopped because of conspirators’ felonies, after XXX invested about $20k of personal funds on the project.

TOTAL PREJUDICE FOR RESTITUTION: $32,000

DAMAGES: $200,000

LEGAL FEES: est $25,000
