My elderly mother purchased a 21 inch TroyBuilt electric start mower from Lowes and purchased the extended warranty with the mower. About two 4 weeks ago, the blade came off of the mower and we took the mower to our local Lowe's store per the warranty program for them to ship the mower off for repairs.

The mower was looked at by the Lowes Service Center in Dallas, Texas. Approximately 4 days later, we were notified by the service center that: 1) there was no oil in the mower, 2) the blade could not be repaired, 3) the motor was shot and not able to start. We were further notified that the mower would need a new motor and that the total cost would be about $320.00.

I asked the service center to recheck the mower due to the fact that the mower was operating just fine prior to the blade coming off. Again, we got a phone call from the service center confirming their first check of the mower and the service center was very clear that the motor was shot and would not start and that the mower was in need of a new motor for about $320.00.

I told the service center to just tighten the blade up for us and to send the mower back. About 2 days later I picked-up the mower. Having come to the rea;ization that if I was ever going to cut my mother's yard for her, I would have to go buy a new mower.

Now move ahead 2 weeks following the date of when the mower came back, My mother's back yeard had grown to about 16" and needed to be cut. I attempted to start the mower but yet, the blade had not been reattached. Knowing what little I know about mowers, I filled the tank with gas and reattached the blade. To my shock and the shock of all Lowe's personnel, the mower started. I was able to cut my mother's yard.

I spoke to Lowe's Service Advantage headquaters and was adviced to take my concerns up with my local store. I went to the local store and asked everyone that would listen to me as to how "a mower that had a shot motor could just start right up after reattaching the blade and filling the tank with gas." No once could answer my question.

I then informed the local store and Lowe's Service Advantage that I felt like they were attempting to take advantage of my elderly mother. I also informed them that I felt they were committing DTPA and attempting to take advatange of my elderly mother.

I requested that the mower be sent back for the service center to recheck and wanted them to explain to me, when the motor was able to repair itself with no work being performed on it.

I also advice all parties that I had videotaped the mower's serial number, model number and that I had actually started the mower on camera to prove that the motor was working prior to it being shipped back to the service center.

I informed Lowe's that by thier refusing to honor the terms and conditions of the extended warranty that they had breached the contract and that by their attempting to convince my elderly mother to spend $320.00 for a new motor was considered illegal in Texas and that I was going to file a compliant with the Texas Attorney General's Office, Consumer Protection Agency and that I would seek legal recourse in federal court for their attempted act of fraud against my mother.

I would advice anyone who purchases the extended warranty program through Lowe's to video document all information about your product and that before they agree to what Lowe's service center states is wrong with your product that they get a second opinion.

If they attempted this fraud against my mother, how many other consumers have been ripped off?
