On November 15, 2014 I was in a drive thru lane of Chick-A-Fila 8016 Denton Hwy Watauga, TX 76148 and a delivery driver from your was making a delivery. The drive thru lane was full as usual and instead of the driver waiting until the lanes were clear to make his delivery, he proceeded to go in between cars. He misjudged the space and hit my car pulling a heavy pallet across the lanes. He hit me so hard that he caused my car to move. I put my car in park, got out of the car and confronted him. He denied ever touching my car but you could clearly see that the pallet was up against my bumper.

I proceeded to get back into the car, paid for my meal, took down his license plate information and later reported the incident to MBM Corporate offices. They contacted the local office in Lewisville Texas and Mr. Richard Krause called me later in the day. He was apologetic and assured me that they took safety seriously and would do an investigation. He texted his telephone number and instructed me to send photographs. On November 16, 2014, I went to Caliber Collision and received an estimate of $793.52. I sent him the information and his reply was "I didn't get the estimate, but I'll forward these photos to the insurance carrier with the rest of your info. You stated in our conversation that you had no damage.

I'm disappointed that you left the scene and didn't allow our driver to photograph the bumper. He was certain that to and he viewed the bumper and found none. But as I said I'll forward the report to our carrier.

Ryder claims will be in contact with you." I never told Mr. Krause that I didn't have damage. It was too dark to access any damage. The driver wasn't trying to take pictures or inspect damage because he denied ever hitting me. Mr. Krause was slow in forwarding my information to Ryder.

I called Ryder and started a claim on my own. About three or four days later Denise Fashing contacted me and took my statement. She was unfriendly, aloof, and disorganized. She took my information and said that based on what I’ve told her she wasn’t sure that I had a claim but she would have to contact MBM Corporation and speak with the driver to get his side of the story. I forward her the estimate along with the pictures and a couple of days later she called and left a message indicating that she would have an adjuster come and inspect my vehicle.

He came to my place of employment on November 24, 2014 and inspected my vehicle. He was unfriendly and aloof as well, took pictures, inspected my vehicle and left. I received a call on November 26, 2014 and Denise basically told me that the adjuster findings were damage caused by rock chips not by the delivery driver. First of all, where the damage is located on my vehicle it’s next to impossible for rocks to reach that high, second, I just had some repairs done on my vehicle a month ago and those damages weren’t there.

It’s clear that your company is more about delivering product on time by any means necessary and safety isn’t a priority. I’ve seen your delivery drivers moving product while cars are moving through the drive thru numerous times and said to myself that one day that was going to cause a serious accident, but I never thought that I would actually be in that accident, and for him to stand there and lie because he didn’t want a blimp on his driving record is unacceptable.

At what point do your company and its employees take responsibility for their actions? When will they suffer the consequences for their wrong doing? Even if you don’t believe that your driver hit me, do you see the wrong in him moving tall pallets of goods though a busy occupied drive thru? Do you see the safety hazard in that?

I would like either MBM Corporation or your insurance carrier Ryder Claims to pay for all repairs to my vehicle. I shouldn’t have to pay the price for your employee’s negligence.
