On May 31, 2014 I submitted an Email to Rosenbaum fence to provide me with an Estimate and Proposal. That is all I agreed to was an estimate and proposal. No further contact until July 21, 2014 when they showed up while I was working and installed fence.. I never paid them any money to do the work. We did not agree to the work being done. Hence No money ever exchanged. When I did contact them a man by the name of walter said everything is approved and ready to go and is paid for. I thought wow someone did this on my behalf. About a month later they contact me and send me an invoice and said I owed them money. I said absolutely not I did not approve of the work being done. I made up all kinds of excuses to get these shady people to leave me alone including arrangements that I purposely did not go through with. My HOA contacted me and said the Fence is not within regulation and has to be removed. Again I kept telling these people to come get this fence off my property and they would not concede to do so. I also told them I never signed any work never got a permit and in fact the estimate stated that before any work could be done a permit was needed and they never got the appropriate permits to build in the community planned development. I then 8 months later get a notice on my door saying to go to court they are seeking a judgement for the amount of 5690.00 which was not even the original amount. The wood fence is rotted material and very poor quality and in fact some of the posts have come off since installation that I never agreed to. The HOA is now fining me 10.00 a day while this fence is on my property.
On March 15th 2015 I notified the law office that I had other legal appointments and that I could not make it to court due to those legal appointments regarding my dads death. Then I notified the Law office two days prior and the day before and the day of that I was contesting this judgement. They ignored my phone calls they ignored my statements made and told the JUDGE that I was just a no show and they were able to get a judgment granted with an estimate and proposal that is not a contract. They in fact broke the law by doing this. So in essence I asked their Lawyer Neal Rosenbaum to come out remove the fence and replace it with a white vinyl fence within regulation and I would agree to 2500.00 of the money. He absolutely refused this negotiation and in fact told me that they did not make any mistakes and that they are not liable and that they are not removing the fence. Even though I told them that was an Estimate and Proposal and it was never a contract. There was no money exchanged and there was nothing approved from the Homeowners Association and They did what they wanted to do to RIP me off and in a sense take advantage of me being a new homeowner. I am in contact with lawyers who I am hoping to file a lawsuit against this company to remove this fence as it was never contracted by anyone at all nor approved by the HOA in Turtle Creek Newport News Va. They have repeatedly ignored my attempts to get them to remove the fence by law. IF there are any lawyers and anyone who has had shady dealings with this company please feel free to contact me and we will move forward with litigation against this company. They did not follow the proper installation procedures as outlined in the Uniform Commercial Code and they did not follow the law. Please do not do business with this contractor as they will do what they want without you being there and then leave you hanging with the bill or invoice then take you to court to get money that they are not allowed to even have. I strenuously suggest you contact other contractors other than Rosenbaum Fence to build in your neighborhood.
I want to also add that they tried to say I verbally agreed when on the back of the paperwork it states NO Verbal Agreements are considered Valid. My concern is that other people in this planned development will be taken advantage of and lied to and then be left with thousands of dollars to pay. If you wish to help please contact me at once. I did tried to negotiate a deal and they said no. So there are no further dealings with this company. Please do your homework and never use this company to build in your neighborhood or on your property. The fence I have is poor quality knot holes nails not alligned cracks no proper height adjustment and no treatment of the wood prior to building. Please beware of this company.
