I need to know who I need to speak to at a local level to file a complaint. I would've never thought that dealing with your company would jeopardize my CDL. Since working with your medical staff and DOT physical it was not sent to the department of transportation in a timely manner and now my CDL has expired due to noncompliance with my DOT physical. I am out almost $1000 for the money it cost me to complete the testing and money associated with schooling. I'm sure Swift could care less they stole 90 days of my life as well.

I know many of you people out there need jobs and willing to go to the depths of hell for one, but take my advise and dont go to Swift Trucking school. I am looking for people who went to Millington for their school and witnessed the 4 man hotel rooms, the herding to and fro the training area and the nonsensical classroom training you had to ebdure. The entire time in the 4 weeks of training I actually drove a truck was for about 45 minutes to an hour. The entire time was devoted to backing up which would have only taken me one full day of practice to pass in a truck on my own, but instead of having one full day on your own you have 2 or 3, 7 day weeks struggling to even get a chance to get into a truck and then having to switch with others every 15 to 20 minutes and get back in the truck 3 hours later forgetting what you did right or wrong the last time.

I had my Class A already so they basically just passed me in everything and gave me literally zero training, otherwise I would have gone straight to the orientation and saved myself 4400 dollars.

After I had completed my training I was sent with a dedicated driver mentor who did about a 6 to 8 hour run every 3 days. The truck was stationed in the middle of nowhere in Lake City next to a Huddle House. That was to be my new home while the mentor lived in a campsite with full amenities like "a shower". The truck broke down the first day so I was put up in a hotel for 8 days doing NOTHING- wasting time. Then it was back to the truck with no shower facilities and into the Huddle House to shave etc. (This was not a truck stop folks). Anyway I requested to be with someone over the road because at this rate I would not have my own truck for around 6 months and be in 100 degree weather with no shower.

I got with another trainer after waiting nearly 2 weeks this was by the direction of the driver MGR. She told me she was getting me a new mentor so I told my current mentor and he told me I had to leave now and then wrote that I couldnt drive unless I had a shower every 12 hours (lie).

The new mentor was a complete idiot, he told me his brother was in the CIA and killed people for a living and because I asked questions he couldnt answer he decided he was going to screw me. He drove me all the way from Atlanta to Memphis when I was supposed to be driving and then told me I didnt have the "basics" to drive a truck.

Now I am in debt 4400 with interest and kicked out because I didnt have the basics when I had a 95 in the school. I explained that I didnt have time to be thrown around like a rag doll and that my other bills were building up and could not go back to a school I already passed with flying colors. I know it was not because of my driving ability with either mentor, but when someone can use any excuse to dump you, they could do that to you forever. If a mentor claims that I dont have the Basics to drive a truck than Swift owes me money and not the other way around.

Looking for a good lawyer and others who had similar problems with Swift...and I know there are many.

Hi, I just about two months ago started with swift and since I was being trained I was being payed $8.50 an hr and had worked over a 140hrs. And decided to not pay me a cent. then I got a blood clot on the job and they did every thing they could to keep me from get help. then they told me I could not see my doctor only they'res and when I called them to have them get me to one of they're doctors they never called me back since to have been confirmed that I had a blood clot they have never saw if I was ok or even respond to me at all forcing me to get a attorney. I don't even know if I still have job but if they terminate me while on medical leave my attorneies will have field day. For all those company people, i.e. Current Drivers, little girls in the office or anyone else currently employed by Swift You may post as many rebuttals, explanations or statements of disagreement as you like, however I will not respond further to anyone from Swift. ALL relevant facts are stated herein]

This correspondence is written by a past employee in an effort to solicit participants to determine feasibility of a possible class action lawsuit against Swift Transportation for violation of Federal Labor Laws and/or the FLSA.

Lets start with Swift Driving School: A prospective Driver enrolls in the School, fills out all the paperwork, continues through School and graduates, is assigned a mentor then graduates and is assigned his/her own truck.

Part of the required paperwork to be signed prior to starting School is a Tuition Reimbursement Agreement to be payroll deducted -- {paraphrased clause} In the event the Driver's employment ends, Swift may withhold the employees last payroll check to be applied toward any remaining unpaid balance due on Tuition.

(A)Swift policy states that Drivers who are on duty, not driving will receive breakdown pay and/or reimbursements for overnight motel bills, or both.

(B)Federal Law states: a Driver is on duty, not driving, waiting on a dispatch during a 7 day period, the Driver drives a total of 800 miles for a week @ .34 per mile = $272.00. On duty time = 56 hrs. Average hourly rate = $4.85 per hr. The Driver must be paid equivalent to $5.85 per hr. Federal Minimum Wage.

(C)Federal Law requires ALL Swift Drivers who are on duty between Monday thru Sunday of ANY week, to average $5.85 per hour for all on duty hours, it DOES NOT matter how many miles are driven. (this includes time waiting on a load or any other on duty time)

(D)Example: After your home time ends (on Sunday) and you receive your first dispatch to begin your next 14 day work period (on Monday), your payroll check for week 1 should not be less than $409.50 and, your payroll check for week 2 should not be less than $409.50, it does not matter how many miles are driven.

(E)You are a past employee Driver and have received phone calls or a correspondence from Collect America Commercial Services, Inc. 16011 College Blvd. Suite 101, Lenexa, KS 66219 regarding a debt owed for Swift Driving School and you did not receive your last payroll check or your last payroll check did not include pay for which you submitted BOLs or receipts.

Once a Driver's employment ends with Swift, the unpaid tuition balance is turned over for collection. The Driver's last check is withheld by Swift. The amount of unpaid wages and any other money owed to the Driver IS NOT deducted from the outstanding tuition balance that Swift attempts to collect. Federal Law requires ALL earned wages to be paid.

Current and past employee's who are interested in the possibility of recovering back pay and wages due, please respond to this complaint. Current employees please do not disrupt the work place or solicit participants on company time or on Swift premises.

Respondent's, please understand we will need 10-15 willing participants who will be directed to a website for screening at a later date. This will prevent company management from posing as a participant or interfering with the effort. The website and additional information will be posted here, please check back every week or two for the next several months.

This company promises consistent miles, regular home time and a family like environment where you, the driver, is number one. This unfortunately is all a lie.

I NEVER, not once in my entire career there, ever got home on time. They train their driver managers to purposely delay your home time. I have heard driver managers say “Keep him (a driver they were talking about) out at least two extra days”. They don’t care about you. They will send you loads going in the opposite direction. They will send you one state over from where you are supposed to be and promise to get you a load going home only to sit you there OR change your delivery time to two days later. I was already 7 days past my home time date when I had an uncle pass away. They still wouldn’t get me home. They still tried to send me anywhere but home. Simply put, don’t expect to get home even if you have an emergency.

They promise consistent miles. LIE. I would run 3000 miles one week and 1000 miles the next four weeks. They would send me a load that was only 400 miles but the delivery date was 3 days out. They wouldn’t let me tcall or switch loads with someone who maybe needed a reset. That happened at least once a week.

Never lease a truck with this company either. They will push that on you from day one. It is a total scam. They say you are your own boss and can run the truck however you want but the truth is that they still own that truck. The only reason they want you to be an “owner op” is so they can put all of the liability on you with none of the risk. In fact, they make more money off of you leasing a truck than being a company driver. And don’t expect any help or recourse if you happen to get lemon like I did. I had nothing but problems with the truck I leased. It was in the shop every other week. Once I signed on the dotted line I couldn’t even get someone on the phone to talk to about the issues I was having. The few call backs I did get basically said “your truck, your problem”. It is a total scam.

In conclusion, this company is the epitome of evil corporate attitude. They lie about every aspect of their business. They treat their drivers like garbage and don’t care how much you have to deal with as long as their shareholders keep getting their dividends. It’s not just the higher ups that act this way. It’s everyone from the terminal managers, to the planners and even the driver managers. I have worked for many large companies and never have I been treated so poorly. I can not believe that this company is allowed to treat their employees this way and have no repercussions. I have never walked out on a company until last week. I simply could not work for this company anymore.

Swift took me in, trained me to get my CDL for $4,000. So far so good, right? Well when you go to trucking school you are put in a room with 3 other guys in literally section 8 housing. Suppose you are in the 50% that pass their permit test, don't use drugs and are in decent physical shape. You get there and start trucking and they will work you like a dog. I asked if I could take a day off ""NO, get going. You don't need a day off, you need to get going"". Literally what they said to me. I had been going for weeks straight.

They don't care about their drivers. If the place you are getting loaded at takes 4 hours, you aren't getting paid. The regulations are insane (although admittedly not Swifts fault). We had originally agreed that I would work for them for a year and I wouldn't have to pay back the loan. Well I got fired after 6 months for mostly reasons beyond my control:

A guy at a truck stop threatened me, I responded in a recpricating manner. He called the company and said I threatened him. Low and behold company took his side WITHOUT investigating.

A bar from a security shack came down on my truck while leaving a DC. The guy laughed and said it seems to happen every other week. Swift instantly said it was my fault even though my mentor and the employee had witnessed it as not being my fault.

When you go around turns too fast it sets off a sensor being a ""critical event"". This happened twice to me. Once I was trying to get to a truck stop before my mandatory day had to end, got stuck behind a slow moving semi. Another was a steep decline followed by a steep incline.

I was never in an accident. Never got a ticket. Worked my tail off nearly 6 months straight (didn't take more than 2 days off the entire time). Never late picking up or dropping off a load. Always turned in everything (all the dumb classes and paper work) on time. Dotted my i's and crossed my t's, FIRED.

You are a number for Swift. Simple as that. The ""driver manager"" should be renamed ""number manager"". Because that is what they do, crunch numbers. When they think you are a risk to their safety record, no matter if it makes sense or not, they will fire you. Now I have a collection agency calling and asking why I won't pay. Because THEY broke the contract, not I. I was willing and able to work for them and they fired me for erroneous reasons. And they wonder why they have so much trouble retaining drivers. 9 out of 10 driver turnover every year.

A few things to consider before entering trucking profession in general:

It's lonely as hell.

There are tons of regulations.

You will most likely become overweight from the sedentary lifestyle.
