My husband slipped and fell at our apartment complex on Dec 2012. The results of this incident were severe, as my husband broke his back and has not been to work ever since. We moved from San Diego that year (2012) to be closer to my son whose wife just had their baby.
As a result of his injury we fell behind on our rent. I spoke to apartment manager, Trevor to help us set up a payment plan for that month, and Trevor agreed-Soon after we received an eviction notice. When we called Trevor and spoke to him, he stated that he was sorry and could no longer speak to us and will see us in court. It stated on the eviction notice that we had not paid the amount ($400) that was agreed. We paid him the $400 on the beginning of the month in May. During the 2nd week of May we were going to pay the remaining balance of $200 like the payment plan stated.
When we showed up to court, The Law offices of Kirk A. Cullimore were representing the apartment complex. They asked for proof of when the $400 we paid. I showed them the receipt and they stated since we were in court that they were going to proceed with the eviction. I was unsure of the reason when I had just showed them proof that the amount that was due was paid. The Judge set another court date so he can hear our case. At the hearing The Law offices of Kirk A. Cullimore were more than 30 minutes late and the Judge patiently waited. I knew then that we did not stand a chance with hearing and we were going to be evicted and have nowhere to live. If the situation would’ve happened vice versa and we were late they would clearly rule in their favor. We were evicted right after the hearing.
We thought that this situation was fixed so we didn’t hear from them again. Then all of a sudden 25% of my wages are being garnished and I didn’t understand why. It turns out The Law offices of Kirk A. Cullimore sent a notice that we never received to our old apartment complex, in which they had the knowledge that we no longer lived there. At the court date they ruled in their favor to evict us and to garnish my wages for more than $4000.00 dollars. There was no communication what so ever from the court they the court hearing had to do with garnishing my wages. I called the court to ask them if there is anything that I could do but they said no because it was court ordered. It felt as they didn’t want to help me. I never received mail while I was living there. Our mailboxes were broken and the post office did not want to deliver to broken mailboxes. At times we would find our mail on the floor till one day we had to notify the post office that we would start picking up our mail at the post office. The mailboxes were never fixed until we had moved out.
